(a) Notwithstanding the other terms of this chapter, a nonconforming use of a building, structure or land may be expanded only upon the consent of the Board of Zoning Appeals for the following reasons:
(1) A nonconforming structure may be expanded subject to the most current zoning restrictions for the area in which the nonconforming structure is located.
(2) The expansion may be for vehicular parking for businesses on it's own lot as well as any adjacent or adjoining lot with the parking area on any lot not to exceed fifty percent (50%) of the total square footage of the lot on which it is situated.
(3) An extension of a nonconforming use may be granted to upgrade or modernize an existing business, such as adding a gasoline pump canopy to a service station. No additional square footage shall be added to a building.
(4) An expansion that makes structural alterations that are required by law, such as meeting handicap regulations.
(b) In granting a variance to allow an expansion of a nonconforming use, the Board of Zoning Appeals shall use the same powers and standards used by the Board in granting conditional uses.
