(a) Should the subdivider/developer and his contractor fail in the proper performance of the work, either in quality of workmanship or with respect to the work schedule, the City will inform the subdivider/developer of the conditions and the subdivider/developer shall be advised that the inspection shall be removed from the project, and that the street shall not be approved for dedication.
(b) Any portion of the improvement completed without inspection will not be accepted for dedication until such tests are made which must show that the work has been properly performed. Such tests, whether they consist of laboratory analysis or actual physical exposure of underground structures, shall be paid for in advance by the subdivider/developer.
(c) In addition to the foregoing tests, the City may require a maintenance bond in the amount of one hundred percent (100%) of the cost of replacement for a period up to five years after the date of completion.
(d) When inspection is no longer required and/or the improvement is completed, the Sub Developers Surety Bond, or certified check, submitted to the City by the subdivider/developer shall be returned to the subdivider/developer upon written acceptance of the project by all appropriate City departments and, satisfactory payment of all inspection fees.
