(a) The owner, or agent of the owner, making application for information regulating the construction or repair of a sidewalk shall, whenever possible, construct the sidewalk parallel to the existing curb line or, where no curb exists, the sidewalk shall be held parallel to the existing pavement centerline and at a height above the curb line approved by the Service Director.
(b) Whenever the existing ground, pavement, adjacent sidewalks, driveways, culverts, drainage ditches or other features will not permit the sidewalk to be constructed parallel to existing curb or street centerlines, then the Engineer may require that the owner, or the agent of the owner, prepare plans indicating the proposed grade of the sidewalk and its relationship to existing sidewalks, driveways, culverts, drainage ditches and adjacent property. Such plans shall be prepared by a registered professional engineer.
