(a) No person shall knowingly do any of the following:
(1) Enter onto any skate park pad or use any skate park apparatus with any device, motorized or otherwise, with the exception of in-line skates or skateboards.
(2) Engage in conduct or create a condition that presents a risk of physical harm to the offender or another, or the property of another.
(3) Fail to abide by any posted rule or regulation promulgated by the Salem Park Commission and posted at or around any skate park facility.
(b) Definitions:
(1) Skate Park Pad for the purposes of this section shall be defined as all of the area comprised of the concrete, paved or other hard packed surface upon which the skate park apparatuses sit or are otherwise affixed.
(2) Skate Park Apparatus shall be defined as any natural or constructed object sitting on or affixed to a Skate Park Pad.
(c) Whoever violates this section is guilty of failing to abide by Skate Park Rules and Regulations and is guilty of a minor misdemeanor. Any person who violates this section and who is a minor, shall be subject to confiscation of any such device, motorized or otherwise, with the exception of in-line skates or skateboards that is brought onto or used on the skate park pad or apparatus of any skate park facility with such property being returned to the parent or legal guardian of the minor upon their request.
(d) Subsequent violations of this section within a twelve month period, or any instance where the actions of the offender caused physical harm to another or another’s property, shall result in a misdemeanor of the fourth degree.
