§ 52.01 WATER WASTING AIR CONDITIONING AND REFRIGERATION EQUIPMENT.
   (A)   Definitions. For the purpose of this section, the following terms shall have and shall be construed to have the following meanings.
      AIR CONDITIONING SEASON. The period from May 1 to September 30 during each calendar year.
      AIR CONDITIONING SYSTEM. Any combination of equipment, whether compressor or other type, by which heat is removed from the air, the accumulated or effluent heat being wholly or partially removed by the use of water, and which is designed for the maintenance of temperatures of not less than 60°F.
      CAPACITY IN TONS and TONS’ CAPACITY.
         (a)   The name plate horsepower of any compressor prime mover unit for any air conditioning installation.
         (b)   Two-thirds the name plate horsepower of any compressor prime mover unit for any refrigeration installation.
         (c)   In the event the name plate horsepower is not indicated, CAPACITY IN TONS or TONS’ CAPACITY shall mean the total maximum B.T.U. per hour capacity of the installation divided by 12,000.
      CHIEF INSPECTOR. The officer or agent as he or she shall be duly authorized to act in enforcement of these regulations.
      CROSS-CONNECTION. A connection or arrangement of piping or appurtenances through which water of questionable quality, wastes, or other contaminants can enter the public water supply system.
      REFRIGERATION SYSTEM. Any combination of equipment, whether compressor or other type, by which heat is removed from the air, the accumulated or effluent heat being wholly or partially removed by the use of water and which is designed for the maintenance of temperatures of less than 60°F.
      SYSTEM. Any combination of apparatus, individual unit, group, or collection of units supplied with water through any single customer service pipe or pipes connected to the public water system, irrespective of the ownership of the units.
      WATER CONSERVING DEVICE. A cooling tower, spray pond, evaporating condenser, or other equipment by which water is cooled and recirculated, thereby limiting the use of water from the public water system to that amount lost through evaporation or by flushing of the equipment.
   (B)   Permit required for installation. After the effective date of this section, no person shall install any air conditioning system or refrigeration system of four or more tons’ capacity without first obtaining a permit.
   (C)   Procedure where system in existence.
      (1)   The owner of any air conditioning system or refrigeration system of four or more tons’ capacity installed prior to the effective date of this section shall in lieu of a permit give notice in writing of such installation.
      (2)   Failure to give such notice shall be a violation of this section.
   (D)   Standards of operation. The following standards of operation are hereby established.
      (1)   Systems of four or more tons’ capacity. Systems of four or more tons’ capacity shall be equipped with an approved water conserving device.
         (a)   Efficiency of water conserving device. The water conserving device required herein shall be of such efficiency that it will operate with not over six gallons of city water per hour per ton of refrigeration. The water level control on the tank or reservoir shall be so adjusted as to prevent waste of water through the overflow.
         (b)   Construction of make-up device. The make-up water connection required herein shall be so arranged that the supply has a physical break between the city water line and such device whereby it is impossible for water to siphon back into the water line in case of low pressure.
      (2)   Systems of less than four tons’ capacity. All systems having a capacity of less than four tons shall be equipped with an approved automatic valve which will shut off the flow of cooling water whenever the air conditioning or refrigeration system is not in operation.
