§ 132.30 PROHIBITION OF USE OR CONSUMPTION OF MARIHUANA IN PUBLIC PLACE.
   (A)   In conformance with the Michigan Regulation and Taxation of Marihuana Act (the "MRTMA"), being Initiated Law 1 of 2018, M.C.L. §§ 333.27951 et seq., consuming marihuana, in any manner or form including smoking, in a public place in the boundaries of the city, or smoking marihuana in a private place where prohibited by the person who owns, occupies, or manages the property, is prohibited.
   (B)   Violations of this section shall be deemed a public nuisance in accordance with Chapter 94 of this Code of Ordinances, and any person who violates this section is responsible for a Class C municipal civil infraction and is subject to the penalties established in § 94.999 and Ch. 37.
   (C)   This section does not supersede rights with respect to the consumption of marihuana on private property to the extent authorized by the person who owns, occupies, or operates such property, as provided in and authorized by the MRTMA, and does not supersede rights with respect to the use of marihuana for medical purposes as provided by any state law allowing for or regulating marihuana for medical use.
