130. GENERAL OFFENSES
130.01 Damage to city property

No person shall injure, deface or otherwise damage any property belonging to the city or to any department of the city. The scope of this prohibition includes, but is not limited to cemetery property, waterworks and property of the Fire Department.

(A) No person shall shoot or discharge within the corporate limits of the city or upon any property owned by the city any gun, pistol or similar device which constitutes a deadly weapon. The Chief of Police or any member of the Police Department is authorized to seize and hold subject to order of the court any such gun, pistol or any similar device which constitutes a deadly weapon, which shall be used, shot or discharged within the city or upon any property owned by the city in violation of this section. Violation of this section shall constitute a misdemeanor and be punishable by a fine or imprisonment or both.
(B) Nothing in this section shall interfere with acts taken properly pursuant to § 92.26.
(C) It shall be a defense to a charge under this section that the firearm was discharged in lawful defense of person or property, or pursuant to the lawful directions of a law enforcement officer.

No person shall spit on the sidewalks of the city or upon the steps, floors, walls or any other part of any public building.

Unless expressly allowed by a permit issued pursuant to Chapter 95, no person shall play any game or throw any stone, ball or other missile in or on the streets or sidewalks of the city.

No person shall burn any refuse or other material on the paved streets or sidewalks of the city.
