§ 10.99 GENERAL PENALTY.
   (A)   Any person, firm or corporation violating any of the provisions of any section or subsection of this code of ordinances for which no other penalty is provided, or failing, neglecting or refusing to comply with same shall, upon conviction, be guilty of a Class 3 misdemeanor and subject to a fine not to exceed $500, or imprisonment not to exceed 30 days, and each day that any of the provisions of this code of ordinances are violated shall constitute a separate offense.
   (B)   A person may not be found responsible or guilty of a violation punishable pursuant to division (A) of this section if, when tried for that violation, the person produces proof of compliance with the provisions of this code of ordinances through any of the following:
      (1)   No new alleged violations of the provision within 30 days from the date of the initial alleged violation.
      (2)   The person provides proof of a good-faith effort to seek assistance to address any underlying factors related to unemployment, homelessness, mental health, or substance abuse that might relate to the person's ability to comply with the provisions of this code of ordinances.
