7-3-6: URINATING OR DEFECATING IN PUBLIC:
   A.   Generally: It shall be unlawful for any person to urinate or defecate in or on any street, sidewalk, alley, plaza, park, public building or in any other place opened to the public or exposed to public view.
   B.   Exceptions:
      1.   This section shall not apply to urination or defecation which is done in any enclosure or other public facility designated for use as a toilet or lavatory.
      2.   This section shall not apply to the act of urinating or defecating in public if the act was due to a verified medical condition or physical impairment that renders the act beyond a person’s bodily control. A person with an impairment shall not include intoxicated individuals or individuals who are impaired due to the ingestion of illegal substances.
   C.   Penalty: Any person found violating the provisions of this section shall be fined in an amount not less than seventy-five dollars ($75.00) nor more than seven hundred fifty dollars ($750.00) for each offense.
   D.   Administrative Adjudication: Violations of this section are subject to prosecution under the Village’s administrative proceedings established pursuant to Title 1, Chapter 4, Article A of this Code, as now or hereafter amended. The provisions of this subsection shall not preclude the Village from using other methods or proceedings to adjudicate alleged violations of this section, including, without limitation, the institution of an action in the Circuit Court of Cook County, or before another administrative tribunal which has jurisdiction to consider the violation.
