7-2-19: OVER OCCUPANCY OF HOTEL OR MOTEL ROOMS:
   A.   The operator of any hotel or motel shall not knowingly allow any room within the hotel or motel that is intended to be used for sleeping to, at any time, be occupied by a number of individuals that exceeds the following formula:
(2 times the number of beds in the room), plus (the number of seating positions on all the furniture provided by the hotel or motel within the room)
   B.   Any individual that contracts for the use and occupancy of a hotel or motel sleeping room shall not allow the room they are authorized to use to, at any time, be occupied by a number of individuals that exceeds the following formula:
(2 times the number of beds in the room), plus (the number of seating positions on all the furniture provided by the hotel or motel within the room)
   C.   The operator of any hotel or motel and any individual that is violation of this section shall, upon conviction, be fined an amount that is not less than seventy five dollars ($75.00) nor more than seven hundred fifty dollars ($750.00) for each offense.
