5-10-6: RECOVERY OF REMOVAL COSTS; LIEN PROVISIONS:
   A.   The cost of removal of the graffiti incurred by the Village shall be recoverable from the owner(s) of the premises, and the Village shall have a lien on the premises for the cost of removal; provided, that within one (1) year after the removal of graffiti from the premises by the Department of Public Works, the Village files notice in the Office of the Cook County Recorder that the Village has a lien for the costs and expenses the Village incurred in removing the graffiti from the premises.
   B.   The notice of lien filed pursuant to subsection A of this section must include:
      1.   A description of the premises sufficient for identification thereof;
      2.   The amount of the costs and expenses incurred by the Village in removing graffiti from the premises; and
      3.   The date or dates when the costs and expenses were incurred by the Village.
   C.   If, for any one parcel, the Village engaged in any removal activity on more than one occasion during the course of one year, the Village may combine any or all of the costs of each of those activities into a single notice of lien.
   D.   The notice of lien must be personally served on, or sent by certified mail to, the person to whom was sent the tax bill for the general taxes on the property for the taxable year immediately preceding the removal activities. The notice must be delivered or sent after the removal activities have been performed, and must:
      1.   State the substance of section 5/11-20-15 of the Illinois Municipal Code (65 ILCS 5/11-20-15) and this section;
      2.   Identify the underlying parcel, by common description (address of parcel); and
      3.   Describe the removal activity.
   E.   The lien may be enforced by proceedings to foreclose as in the case of mortgages or mechanic’s liens. A suit to foreclose such lien shall be commenced within two years after the date of the notice of the lien filed.
   F.   Upon payment of the costs and expenses as set forth in the notice of lien, the lien shall be released by the Village, and the Village shall tender a release of the lien to the owner of the premises in a form which may be filed of record in the Office of the Cook County Recorder of Deeds.
