5-3-3-2: CONTAINER AND ACCESSIBILITY REQUIREMENTS:
   A.   Requirements:
      1.   A container into which rubbish or ashes are deposited on the premises of a single-family house or a condominium shall be watertight and made of durable rigid plastic or galvanized iron or other metal with a close fitting cover. All such containers shall have a capacity of not less than five (5) gallons nor more than thirty (30) gallons and shall be provided with suitable handles. All such containers shall at all times be maintained in good condition.
      2.   Except as provided in subsection A4 of this section, a container into which refuse is deposited that is located on the premises of multi-family residential buildings shall meet the requirements of subsection A1 of this section or be a dumpster provided by a scavenger service licensed by the Village which has a close fitting cover.
      3.   Except as provided in subsection A4 of this section, containers in which refuse is deposited located on premises that are not used for residential purposes shall meet the requirements of subsection A1 of this section or be a dumpster provided by a scavenger service licensed by the Village. If garbage is deposited in a dumpster, the dumpster must have a close fitting cover.
      4.   Containers in which refuse is deposited located on premises in the area of the Village located north and west of the intersection of Mannheim Road and Lunt Avenue or in the area of the Village bounded by Higgins Road on the north, River Road on the east, Glen Lake Street on the south and Shafer Court on the west must be dumpsters provided by a scavenger service licensed by the Village which have close fitting covers and which have a capacity or size of not more nor less than 1.5 cubic yards, unless the premises is a residential condominium unit to which the Village provides waste collection service as provided in subsection 5-3-2A of this chapter.
      5.   All containers in which landscape waste is placed must be biodegradable and must be closed or sealed.
      6.   In addition to being placed in a container or dumpster in accordance with subsection A1, A2, A3 or A4 of this section, all garbage must be placed in a closed or sealed bag.
      7.   Recyclable waste produced or located on the premises of a single-family house or a condominium shall be deposited into the container provided by the Village for recyclable waste or if no such container has been provided by the Village, into a container that meets the requirements of subsection A1 of this section.
      8.   The owners, managers and occupants of all premises are prohibited from placing furniture, appliances or any other item too large to be placed inside a dumpster or other waste container in such a manner that either persons entitled to use a dumpster or other waste container or a scavenger or waste disposal service that has been retained to remove or empty a dumpster or other waste container is hindered or prevented from being able to access the waste container. Any furniture, appliance or other item too large to be placed inside a dumpster or other waste container that is located on the outside of any premises and is intended for disposal shall be removed from such premises within not more than twenty four (24) hours after such item is first placed outside the premises. It shall be the joint and several obligation of the owner and manager of the premises and any occupant of the premises who placed such an item outside on the premises to notify a waste disposal company to remove the item from the premises. Any failure to have an item removed or to notify a waste disposal company as required by this subsection A8 shall constitute a violation of this chapter.
      9.   The owners, managers and occupants of all premises, other than the premises of single-family homes, shall be jointly and severally responsible for keeping the area on the premises where a dumpster or other waste container in which refuse, garbage, trash or other waste is deposited sufficiently clear and unobstructed so that a scavenger or waste disposal service is not hindered or prevented from removing or emptying the dumpster or other waste container. Any failure to maintain a premises as required by this subsection A9 shall constitute a violation of this chapter.
      10.   The owners, managers and occupants of all premises, other than the premises of single-family homes, are prohibited from parking a motor vehicle in the area on the premises where a dumpster or other waste container is located in such a manner that persons entitled to use the dumpster or other waste container are hindered or prevented from accessing the waste container or in such a manner that a scavenger or waste disposal service is hindered or prevented from removing or emptying the dumpster or other waste container.
      11.   The owners and managers of all premises, other than the premises of single-family homes, shall be jointly and severally responsible for keeping the area on the premises where a dumpster or other waste container in which refuse, garbage, trash or other waste is deposited sufficiently clear of snow and ice so that persons entitled to use the dumpster or other waste container are not hindered or prevented from accessing the waste container and so that a scavenger or waste disposal service is not hindered or prevented from removing or emptying the dumpster or other waste container. Any failure to maintain a premises as required by this subsection A11 shall constitute a violation of this chapter.
   B.   Administrative Adjudication:
      1.   Violations of the provisions of this section are subject to prosecution under the Village administrative adjudication proceedings established pursuant to title 1, chapter 4, article A of this Code, as now or hereafter amended.
      2.   The provisions of this subsection shall not preclude the Village from using other methods or proceedings to adjudicate alleged violations of this section including, without limitation, the institution of an action in the Circuit Court of Cook County or before another administrative tribunal which has jurisdiction to consider the violation.
   C.   Penalty: Any person violating any of the provisions of this section shall, upon conviction or upon an administrative determination that a violation occurred, be fined in an amount of not less than two hundred fifty dollars ($250.00) or more than seven hundred fifty dollars ($750.00) for each offense. Each twenty four (24) hour period that a violation continues shall constitute a separate offense.
