5-2-2: NUISANCES DECLARED AND PROHIBITED:
   A.   Dutch Elm Disease: All species and varieties of elm trees (trees of the genus Ulmus) infected with the fungus known as “Dutch elm disease” (Ophistoma/Ceratostomella) are declared to be public nuisances and shall be removed and properly disposed of by the owners of the properties on which such infected trees are located within twenty (20) days following written notice from the Village.
   B.   Emerald Ash Borer: All species and varieties of ash trees (trees of the genus Fraxinus) infected with emerald ash borer (Agrilus planipennis Fairmaire) are declared to be public nuisances and shall be removed and properly disposed of by the owners of the properties on which such trees are located within twenty (20) days following written notice from the Village.
   C.   Offense: It is unlawful to maintain an infected tree within the Village after notice from the Village as provided in this chapter to remove and dispose of an infected tree.
