AN ORDINANCE AMENDING SECTION 3-10-1 OF THE VILLAGE OF ROSEMONT’S CODE OF ORDINANCES TITLED “FEE SCHEDULE”
WHEREAS, the Village of Rosemont is a home rule unit of local government under the provisions of Article 7, Section 6 of the Illinois Constitution;
WHEREAS, except as limited by Article 7, Section 6 of the Illinois Constitution, the Village as a home rule unit of local government has the authority to exercise any power and perform any function pertaining to its government and affairs, including but not limited to regulating for the public safety and the public welfare;
WHEREAS, it has been determined by the corporate authorities of the Village of Rosemont that it is desirable and necessary to update the Fee Schedule to certain fees charged for licenses and other services within the Village; and
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ROSEMONT, COOK COUNTY, ILLINOIS IN THE EXERCISE OF ITS HOME RULE POWERS, as follows:
SECTION 1: Incorporation of Recitals
. The recitals to this Ordinance set forth above are hereby incorporated into and made a part of this Ordinance.
SECTION 2: Amendment to the Fee Schedule.
Section 3-10-1 of the Village of Rosemont’s Code of Ordinances which contains the Rosemont Fee Schedule for Services, Licenses and Permits within the Village of Rosemont shall herein be amended and comprehensively restated in its entirety to provide as follows:
CHAPTER 10: VILLAGE FEE SCHEDULE
It shall be unlawful for any person to engage in or operate any business, trade; or occupation named in this section without paying in advance the license or other fee listed below. Such fees upon collection shall become part of the corporate fund or such other fund as the Village Board shall determine. Any renewal fee which is not received on or before the due date shall be increased in the amount of fifty percent (50%) of the license fee hereinafter set forth, unless otherwise stated.

SECTION 3: Home Rule: This ordinance and each of its terms shall be the effective legislative act of a home rule municipality without regard to whether such ordinance should (a) contain terms contrary to the provisions of current or subsequent non-preemptive state law, or (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Rosemont that to the extent that the terms of this ordinance should be inconsistent with any non-preemptive state law, that this ordinance shall supersede state law in that regard within its jurisdiction.
SECTION 4: All Ordinances or parts of Ordinances thereof in conflict with this ordinance are hereby repealed to the extent of any such conflict.
SECTION 5. This ordinance shall be full force and effect upon its passage and approval and publication in pamphlet form as provided by law.
