The provisions of this chapter shall apply to those residential condominium developments containing four (4) or more dwelling units for which the declaration provided in section 3 and the plat provided in section 5 of the Condominium Property Act are recorded after the effective date hereof. Residential condominium developments for which the declaration provided in section 3 of the Condominium Property Act was recorded prior to the effective date hereof shall not be subject to the provisions of this chapter. The resale of a condominium unit by an owner of a dwelling unit in a residential condominium development that is subject to the provisions of this chapter shall be exempt from the requirements of this chapter unless the owner is also the “developer” or “declarant”, as defined in section 11-9-3 of this chapter.
