11-8-7: RESTRICTIONS AND REQUIREMENTS:
All balloons, banners or tents, as defined by this chapter, which are erected or maintained within the Village, shall be subject to the following restrictions and requirements:
   A.   All banners, balloons or tents must be fixed securely to the ground or to a building or other structure and must be fixed to the ground or to a building in accordance with the written documentation submitted to the Director of Public Works pursuant to section 11-8-3 of this chapter. A banner, balloon or tent shall be considered to be fixed securely if the banner, balloon or tent is attached to the ground or to a building or other structure so that it will not become loose in wind gusts of up to sixty (60) miles per hour.
   B.   No part of any balloon shall be located: 1) within fifty feet (50') of the right-of-way for a limited access highway which has five (5) or more lanes; 2) within fifteen feet (15') of the right-of-way of a State highway; or 3) within five feet (5') of the right-of-way of any other roadway.
   C.   No tent or banner shall be erected or maintained so as to encroach onto or over a public right-of-way except for banners or tents that are erected and maintained by a unit of Federal, State or local government.
   D.   No tent, banner or balloon shall be erected or maintained so as to encroach onto any adjacent parcel without the consent of the owner or occupant of the adjacent parcel. No banner or balloon shall be erected or maintained at a height greater than sixty five feet (65') above grade.
   E.   No tent shall be erected or maintained at a height greater than thirty feet (30') above grade.
   F.   No tent, banner or balloon shall be made out of a flammable material.
   G.   A balloon shall be inflated only with either helium or air.
   H.   Except during the period beginning on Thanksgiving Day and ending on the following January 15, no balloon shall be erected and maintained for a period longer than ten (10) consecutive days, and no banner or tent shall be erected and maintained for a period greater than thirty (30) consecutive days.
