§ 154.006  RULES; DEFINITIONS.
   (A)   In the construction of this chapter, the rules and definitions contained in this section shall be observed and applied, except when the context clearly indicates otherwise.
      (1)   Words used in the present tense shall include the future, and words used in the singular number shall include the plural number and the plural the singular.
      (2)   The word shall is mandatory and not discretionary.
      (3)   The word may is permissive.
      (4)   The masculine gender includes the feminine and neuter.

   (B)   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      ALLEY.  A public or private right-of-way primarily designed to serve as secondary access to the side or rear of those properties whose principal frontage is on some other street.
      ARTERIAL STREET. This type of street should interconnect with and augment the urban principal arterial system and provide service to trips of moderate length at a somewhat lower level of traffic mobility, while providing access to abutting property; subject to the necessary control of entrances, exits and curb use so as to increase the capacity and improve the safety characteristics of the street.
      BLOCK.  A tract of land bounded by streets, or by a combination of streets and public parks, cemeteries, railroad rights-of-way, shorelines of waterways, or boundary lines of the Village.
      BUILDING. Any structure built for the support, shelter, or enclosure of persons, animals, chattels, or movable property of any kind and which is permanently affixed to the land.
      BUILDING SETBACK LINE. A line within a lot or other parcel of land so designated on the recorded plat, between which a line and the adjacent boundary of the street the erection of a building is prohibited.
      COLLECTOR STREET.  This type of street should provide both land access to abutting property and traffic circulation within residential neighborhoods, commercial, and industrial areas.  The urban collector should collect traffic from these areas and the local street system and channel it into the arterial system.
      COMMERCIAL/INDUSTRIAL. This type of street serves to provide access to abutting commercial and industrial property.
      CUL-DE-SAC.  A local street with only 1 outlet and having an appropriate terminal for the safe and convenient reversal of traffic movement.
      EASEMENT. A nonprofitable interest in land owned by another that entitles its holder to a specific limited use.
      FINAL PLAT.  A map and any accompanying material prepared by the subdivider and approved by the Village in accordance with the provisions of §§ 154.090 through 154.093 to be recorded as a subdivision.
      FRONTAGE. The length of the front property line of the lot, lots or tract of land abutting a public street, road, highway, or rural right-of-way.
      GRADE. The slope of road, street, or other public way, specified in percent (%) and shown on street profile plans as required herein.
      IMPROVEMENT, PUBLIC.  Any sanitary sewer, storm sewer, drainage ditch, water main, roadway, parkway, sidewalk, pedestrian way, planting strip, off-street parking area, or other facility for which the Village may ultimately assume the responsibility for maintenance and operation.
      LOT.  A portion of a subdivision or other parcel of land with access to a public street intended for transfer of ownership or for building development.
      LOT KEY.  A lot located between two corner lots which are fronting on other streets.
      LOT, CORNER. A lot situated at the intersection of 2 streets, the interior angle of the intersection not exceeding 135 degrees.
      LOT, THROUGH.  An interior lot which has a pair of opposite lot lines extending between 2 substantially parallel streets.  On a THROUGH LOT both street lines shall be deemed front lot lines.
      OWNER. Any person, group of persons, firm or firms, corporation or corporations, or any other legal entity having legal title to the land sought to be subdivided under this chapter.
      PEDESTRIAN WAY or CROSSWALK.  A right-of-way across or within a block, for use by pedestrian traffic, and may include utilities where necessary.
      PRELIMINARY MAP.  A map showing the salient features of a proposed subdivision, submitted to the Planning Department for purposes of preliminary consideration.
      RESIDENTIAL STREET.  This type of street comprises all facilities not on 1 of the above systems.  This type of street serves only to provide access to abutting property and service to residential areas.
      RIGHT-OF-WAY.  A strip of land occupied or intended to be occupied by a street, crosswalk, railroad, electric transmission line, oil or gas pipeline, water main, sanitary or storm sewer main, or for another special use.  The usage of the term RIGHTS-OF-WAY for land platting purposes in the Village shall mean that every plat is to be separate and distinct from the lots or parcels adjoining the rights-of-way, and not included with the dimensions or areas of the lots or parcels.  RIGHTS-OF-WAY intended for streets, crosswalks, water mains, sanitary sewers, storm drains, or any other use involving maintenance by a public agency shall be dedicated to public use by the maker of the plat on which the RIGHT-OF-WAY is established.
      ROADWAY.  A surfaced portion of the street available for vehicular traffic.
      SEWAGE DISPOSAL SYSTEM, INDIVIDUAL.  A septic tank, seepage tile sewage disposal system or any other sewage treatment device approved by the Village Engineer as being in accordance with the rules of the Winnebago County Health Department and as being within the terms of the intergovernmental agreement between the Village of Roscoe and the Rock River Water Reclamation District dated October 24, 1988, and the provisions of Village Ordinance 1991-15.
      SIDEWALK. That portion of a street or crosswalkway, paved or otherwise surfaced, and shall be for pedestrian use only.
      STREET.  A public right-of-way which affords a primary means of vehicular access to abutting properties, whether designated as a street, avenue, highway, road, boulevard, land throughway, or however otherwise designated, but excepting an alley or driveway to buildings.
      STREET, HALF.  A street bordering 1 or more property lines of a tract of land in which the subdivider has only allocated a part of the ultimate right-of-way width which is not permitted by this chapter.
      SUBDIVIDER.  Any person or corporation or duly authorized agent who undertakes the subdivision of land as defined herein.
      SUBDIVISION. The division of any parcel of land into 2 or more parts, any of which parts is less than 5 acres, for the purpose of ownership transfer or building development, or, if a new street is involved, any division of a parcel of land.  The term includes any division of land that attempts to avoid the requirements of this chapter.  Where appropriate to the context, the term shall relate to the process of subdividing or to the land subdivided.
      SUBDIVISION DESIGN STANDARDS.  Refers to the Planning Department report of that title, which report shall be considered a statement of principles of sound subdivision design, by means of which subdividers may be guided and in terms of which each subdivision shall be judged insofar as the principles are reasonable and appropriate in their application to the subdivision.
      ZONING ORDINANCE.  The Village of Roscoe Zoning Ordinance, and subsequent amendments thereto.
