1373.08 MISCELLANEOUS LIMITATIONS.
   (a)   Other Burning.
      (1)   No person shall cause or allow the burning of waste described in Section 1373.01(g) through (k), or Types 0, 1, 2, 3 and 4 thereof, in other than an incinerator as provided in this Chapter.
      (2)   No person shall cause or allow the burning of waste described in Section 1373.01(l) and (m), or Types 5 and 6. Wastes of Type 5 or 6 must be hauled out.
   (b)   Nuisances. No person shall continue, use or maintain a building, structure or place for the exercise of a trade, employment or business, including apartment buildings, which, by occasioning noxious exhalations or noisome or offensive smells, becomes injurious to the health, comfort or property of individuals or of the public. The test to be applied to the foregoing sentence is whether there is substantial injury to the owners and occupiers of property, assuming their being persons of ordinary sensibilities, which interferes sensibly with their use and enjoyment of their respective abodes or businesses.
