ADOPTING ORDINANCE NO. 55-12

AN EMERGENCY ORDINANCE TO AMEND, REORGANIZE OR DELETE VARIOUS TITLES AND CHAPTERS WITHIN THE CODIFIED ORDINANCES OF THE CITY OF ROCKY RIVER.
WHEREAS: the Administration of the City of Rocky River, including the Departments of Law, Police, Fire, Building and Human Resources, in consultation with The Walter H. Drane Company, a consultant regarding the publishing and editing of codified ordinances, has deemed it desirable and necessary to provide a consolidated review for the purpose of amending, reorganizing or deleting various provisions of its Codified Ordinances; and
WHEREAS: included within the recommended amendments and/or deletions to the Codified Ordinances are various titles and chapters, including Chapters 138, 139, 141, 143, 144.02, 145, 147, 148 and 150 of Part One - Administrative Code; Chapters 301, 303, 305, 311, 313, 331, 333, 335, 337, 339, 341, 351, 353, 371, 373 and 375 of Part Three - Traffic Code; Chapters 501, 505, 509, 510, 513, 517, 521, 525, 529, 533, 537, 541, 545, 549, and 553 of Part Five - General Offenses Code; Chapters 701, 713, 717, 721, 723, 733, 741 and 747 of Part Seven - Business Regulation Code; Chapters 953.02, 957.01, 971 and 973 of Part Nine - Streets, Utilities and Public Services; Chapters 1301, 1305, 1309.05, 1309.06 and 1321.05 of Part Thirteen - Building Code; and Chapter 1501 and 1519 of Part Fifteen - Fire Code, as summarized in the attached Exhibit “A”; and
WHEREAS: the new Codified Ordinances of the City of Rocky River identified as complete to March 2, 2012 is in the Law Director’s office and is available for review.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROCKY RIVER, COUNTY OF CUYAHOGA, STATE OF OHIO:
SECTION 1. That the Codified Ordinances of the City of Rocky River shall be amended and/or deleted, including Chapters 138, 139, 141, 143, 144.02, 145, 147, 148 and 150 of Part One - Administrative Code; Chapters 301, 303, 305, 311, 313, 331, 333, 335, 337, 339, 341, 351, 353, 371, 373 and 375 of Part Three - Traffic Code; Chapters 501, 505, 509, 510, 513, 517, 521, 525, 529, 533, 537, 541, 545, 549 and 553 of Part Five - General Offenses Code; Chapters 701, 713, 717, 721, 723, 733, 741 and 747 of Part Seven - Business Regulation Code; Chapters 953.02, 957.01, 971 and 973 of Part Nine - Streets, Utilities and Public Services; Chapters 1301, 1305, 1309.05, 1309.06 and 1321.05 of Part Thirteen - Building Code; and Chapter 1501 and 1519 of Part Fifteen - Fire Code, as provided in the codified ordinances identified as complete as of March 2, 2012.
SECTION 2. That this Ordinance is declared to be an emergency measure necessary for the immediate preservation of public peace, health and safety, and for the further reason that this legislation provides for the adoption of a consolidated update of much of the City of Rocky River Codified Ordinances, and provided it receives the affirmative vote of two-thirds (2/3) of all members elected to Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor, otherwise it shall take effect and be in force from and after the earliest period allowed by law.
