Incidental removal or stripping of top or surface soil from any lot or parcel of land or portion thereof in the City by the owner or lessee thereof, not exceeding a total of three cubic yards, is hereby expressly excepted from the provisions of this Chapter. Should the total removal or stripping at any future time reach such maximum of three cubic yards, the provisions of this chapter will apply to all future removals and stripping. If the quantity thereafter to be removed or stripped is less than three cubic yards, the Director of Public Safety Service may waive the bond and public liability insurance provision and issue a permit, provided he first determines that such additional soil removal will not violate the intent and spirit of this chapter and that such proposed additional soil removal will not be detrimental to public peace, health, property and safety.
