(a) Any entity in violation of this Chapter who does not rectify the violation within a reasonable time period shall be penalized as provided in the State statute or as determined by the Director of Public Safety-Service and Council and shall not be less than the damage incurred to the collection system or the treatment system. Each day shall constitute a separate violation subject to penalty.
(b) Whoever violates any provision of this Chapter shall be guilty of a minor misdemeanor for the first offense. Whoever violates any provision of this Chapter shall be guilty of a fourth degree misdemeanor for the second offense or subsequent offenses.
