The following standards and principles of design in this subchapter shall guide the laying out of the following zoned properties: B-1, B-2, I-1, I-2 and R-5.
(A) Required submittals. If the property is over three acres, and/or has shared access, and/or has more than one principal building, the property owner shall submit to the Plat Officer the following information and additional requested information for review and recommendation by the Village Planning and Zoning Commission to the Village Board and for approval or disapproval by the Village Board before a building permit will be issued:
(1) Nine copies of the site plan with all information as outlined in this chapter shall be submitted to the Village Manager. The Village Manager shall distribute seven copies to the Planning and Zoning Commission, one copy to the Village Engineer, and one copy shall be retained by the Village Manager; and
(2) Nine copies of the site plan modified as required by the Planning and Zoning Commissions comments (if agreed to) as outlined in this code shall be submitted to the Village Manager. The Village Manager shall distribute seven copies to the Village Board, one copy to the Village Engineer, and one copy shall be retained by the Village Manager.
(B) Optional submittals. The property owner may submit the following information and additional requested information for review and approval by the Village Engineer concurrently with the submittal of the site plan or after the site plan has been approved. No building permit will be issued until the site plan and construction plans have both been approved.
(1) Three copies of construction documents (such as drawings, specifications, and addendums) with proper architect/engineer seals and signatures as required by § 154.048(B)(1), (B)(2) and (B)(3), as applicable, licensed in the state, shall be submitted to the Village Manager for distribution;
(2) Permit fee value shall be as set by the Village Board;
(3) All new and remodeled structures shall be required to comply with this code and shall provide all required professional design seals and signatures for buildings that are included in the following zoning classifications:
(a) Zoning district B-1;
(b) Zoning district B-2;
(c) Zoning district R-5;
(d) Zoning district I-1; and
(e) Zoning district I-2.
(4) Copies of all structural calculations shall be submitted for file purposes to the Village Manager for buildings that meet any of the following criteria:
(a) Any structure which has two or more floors that are intended for public occupancy and has total square footage per floor of 2,000 or more;
(b) Any single-story structure that exceeds 30 feet in height as measured from the finished first floor to the peak of the roof; or
(c) A copy of the shop drawings for any pre-engineered metal building including the stamp of an architect or engineer licensed in the state.
(C) Procedure.
(1) Procedure for the Planning and Zoning Commission shall be as follows:
(a) The Village Manager shall distribute to the Planning and Zoning Commission members and Village Engineer, at least ten days prior to the next meeting of the Planning and Zoning Commission, eight copies of the site plan along with copies if any of written recommendations of the Village Manager, Village Engineer, and/or the Director of Building and Zoning, or others to whom prints of the site plan have been directed.
(b) The date of the meeting of the Planning and Zoning Commission wherein the site plan is first presented shall be deemed the formal application date. Within 45 days of the formal application date, the Planning and Zoning Commissioner shall either recommend approval, recommend conditional approval with modifications or recommend disapproval of the site plan, if the Planning and Zoning Commission is able to convene a quorum.
(c) The Planning and Zoning Commission shall review the site plan for technical compliance with § 154.111, technical compliance per zoning, and public infrastructure layout.
(d) If the recommendation of the Planning and Zoning Commission on the proposed site plan is for disapproval, then within said 45 day period, the Planning and Zoning Commission shall furnish to the property owner a written statement setting forth the reasons for disapproval and specifying with particularity the aspects in which the proposed site plan fails to conform to this code including the official map.
(e) Planning and Zoning Commission shall present its recommendation to the Village Board at the next regularly scheduled Village Board meeting unless the 45-day time limit has been extended by mutual consent of the property owner and the Planning and Zoning Commission.
(2) Procedure for the Village Board shall be as follows:
(a) The Village Manager shall distribute to the Village Board and Village Engineer, at least seven days prior to the next meeting of the Village Board, eight copies of the site plan along with copies if any of written recommendations of the Village Manager, Village Engineer and/or the Director of Building and Zoning, or others to whom prints of the site plan have been directed.
(b) The date of the meeting of the Village Board wherein the site plan is first presented shall be deemed the formal application date. Within 30 days of the formal application date, the Village Board shall either approve, approve with modifications or disapprove of the site plan, if the Village Board is able to convene a quorum. The 30-day time limit may be extended by mutual consent of the property owner and the Village Board.
(c) The Village Board shall review the site plan for technical compliance with § 154.111, technical compliance per zoning, and public infrastructure layout.
(d) If the recommendation of the Village Board on the proposed site plan is for disapproval, then within said 30-day period the Village Board shall furnish to the property owner a written statement setting forth the reasons for disapproval and specifying with particularity the aspects in which the proposed site plan fails to conform to this code including the official map.
(e) If the recommendation of the Village Board on the proposed site plan is for approval, then a building permit may be issued when the Village Engineer has approved the construction documents (such as drawings, specifications, and addendums) with proper architect/engineer seals and signatures as required by § 154.048(B)(1).
(D) Fair share assessment fee. Fair share assessment fee shall be issued for all structures and buildings.
(E) Building codes. All public, commercial, industrial and business structures shall be designated and constructed in accordance with the codes adopted by the village as stipulated in the villages’ ordinances, including all village zoning ordinances which are pertinent to the appropriate zoning certification.
(F) Setbacks. Setbacks of permanent structures and/or buildings shall comply with village zoning ordinances which are pertinent to the appropriate zoning certification.
(G) Penalties. Violation of any provisions contained within this chapter and which do not contain specific penalty amounts shall be assessed the dollar value amount as written in § 154.999.
