No owner, occupant, tenant or any other person having a substantial interest in any real or personal property within the town, or agent thereof, shall start, kindle, cause, allow or maintain any form of open burning of any materials on private or public property, except as specifically authorized by § 95.05 of this chapter or upon receipt of a variance pursuant to § 95.06 of this chapter.
