(A) An interested person shall submit a written application for variance to the Clerk-Treasurer. Upon receipt, the application for variance shall be reviewed by the Chief of the town’s Fire Department, and his or her written recommendation shall be provided to the Council. The application for variance shall then be heard by the Town Council at a public meeting and only be effective upon a majority vote of approval.
(B) A fire approved by a variance must have the original permit properly authorized by the Town Council in proximity to the burn site at all times during which the open burning is occurring.
(C) The Town Council cannot grant a variance for burning that would otherwise violate the provisions of 326 I.A.C. 4-1 et seq. and by I.C. 13-17-9, as each now exist and are hereafter amended, modified or superseded.
