1-12-3: TIME TO RESPOND:
The Village Clerk shall respond to a duly filed request for inspection or photocopying of public records within seven (7) working days of receipt of the request. The Village Clerk shall either provide the documents requested within said seven (7) days for inspection or photocopying, or shall deny the request if the requested information is not a public record within the meaning of the Freedom of Information Act. In the event that the Village Clerk cannot comply with the request for information within the initial seven (7) day period for any reason permitted by the Freedom of Information Act, the Village Clerk shall so inform the applicant by letter of his inability to provide that information within the initial seven (7) working days, and the Clerk shall indicate the reason for the delay in the letter to the applicant. In the event that a delay beyond the seven (7) days occurs, the Village Clerk shall fully respond to the request for inspection or photocopying of public records no later than fourteen (14) working days after the initial receipt of the completed application for inspection or photocopying of public records as required by the Freedom of Information Act.
In the event that the Village Clerk is unable to determine whether or not the application seeks public records or nonpublic records, the Village Clerk is authorized to confer with the Village Attorney, or such other persons as are necessary to make a final determination as to whether or not the request of information consists of public records within the meaning of the Freedom of Information Act.
