The following sections of the 2018 International Building Code are hereby added, amended, revised, and changed as follows:
General Amendments
The following sections of the 2018 International Building Code are hereby added, amended, revised, and changed as follows:
Wherever the phrase "[name of jurisdiction]" or the word "jurisdiction" appear, they shall refer to the Village of Riverwoods.
Wherever the phrase "Code Official" or "Department of Building Inspection" appears, it shall refer to the Village of Riverwoods, Director of Community Services or his designated agent(s).
Whenever there is a reference to the "Village of Riverwoods Schedule" or any other general reference to fees or charges, it shall mean the then-current ordinance of the Village setting forth fees, charges, and other costs payable to the Village relating to activities covered by, and the administration of, this Code. To the extent that fees are set forth in this Chapter that are different than the then-current ordinance of the Village setting forth fees, charges, and other costs payable to the Village relating to activities covered by, and the administration of, this Code, the fees set forth in the then-current ordinance of the Village setting forth fees, charges, and other costs shall control.
Specific Code Amendments
Section 101.4.3 Plumbing. Delete the wording "The provision of the International Plumbing Code" and insert the following language: "The provisions of the Illinois State Plumbing Code".
Section 102.2 Other laws. Add "Nothing herein contained shall be deemed to nullify any provisions of the zoning law or any other statute of the Village pertaining to the location, use, or type of construction of buildings, except as may be specifically required by the provisions of this Code".
Section 102.4.3 Insert "Where a conflict exists between the provisions of the Code, the provisions of the Fire District requirements or the Referenced Standards, the stricter requirement shall apply".
Section 102.7 Other Regulations. Add new Section "When the provisions herein specified for health, safety, and welfare are more restrictive than other regulations, this Code shall control".
Section 103.1 Creation of Enforcement Agency. Delete this section and replace with "The Director of Community Services shall be known as the building official".
Section 103.3 Deputies. Add the following at the end of this section "Any reference to the Fire Official shall be to the Lincolnshire-Riverwoods Fire Protection District or Deerfield- Bannockburn Fire Protection District.
Section 103.4 Effective date of this Code: "The effective date of this Code shall be January 1, 2020".
Subsection 105.1.1. Delete.
Subsection 105.1.2. Delete.
Section 105.5 Expiration Delete and replace with "Permits for new construction of primary buildings are valid for 18 months. All other permits are valid for 12 months. Permits shall be renewed only one time, valid for 6 months"
Section 109.2 Schedule of Permit Fees. Insert "The permit fees required by this Code shall be paid to the Village Clerk or the Clerk's duly authorized agent for which the permit card shall be issued. No permit shall be valid until such fees are paid. See the Village Fee Schedule".
Section 109.7. Professional Consultant Services. Insert new "Plans and supporting documents shall not be reviewed by Village Consultants until the appropriate fees have been paid as set forth in the Village Fee Schedule".
Insert new Subsection 109.7.1 Liability for Property Damage. The Village shall deduct from the security deposit the cost to correct any damage to private or public properties which is directly related to the construction for which the permit has been issued.
Section 111.3 Temporary Occupancy. Insert at the end "Temporary certificates of occupancy are valid for 120 days. A security deposit is required as set forth in the Village Fee Schedule". Building permits shall not expire during temporary occupancies.
Section 113 Board of Appeals. Delete and replace heading with: "Means Of Appeal"
Section 113.1 Application For Appeal: "Any person shall have the right to appeal a decision of the building official to the zoning board of appeals. An application for appeal shall be based on a claim that the true intent of this code or the rules legally adopted there under have been incorrectly interpreted, the provisions of this code do not fully apply, or an equivalent form of construction is to be used".
Section 113.2 Disqualification Of Member: "A member shall not hear an appeal in which that member has any personal, professional or financial interest".
Section 113.3 Compensation Of Members: "Compensation of members shall be determined by law".
Section 113.4 Notice Of Meeting: "An appeal must be filed with the zoning board of appeals within 30 days after the date of the building official's decision thereon".
Section 113.5 Open Hearing: "All hearings before the board of appeals shall be open to the public. The appellant, the appellant's representative, the building official and any person whose interests are affected shall be given an opportunity to be heard".
Section 113.6 Procedure: The zoning board of appeals shall adopt and make available to the public through the secretary, procedures under which a hearing will be conducted. The procedures shall not require compliance with strict rules of evidence but shall mandate that only relevant information is received.
Section 113.7 Administration: All decisions of the zoning board hereunder shall be reduced to writing and mailed to the appealing party and the building official. The building official shall take immediate action in accordance with the decision of the zoning board of appeals".
Section 114.4 Violations. Delete "penalties as prescribed by law" and insert the words "a fine of $ 750.00 per week. Each week shall constitute a separate offence."
Section 116.6 Unsafe Structures and Equipment insert new "Boarding up a vacant or unsafe structure is considered a temporary measure until a decision is made as to what remedy the owner wants to pursue as provided in this section, but in no case can a building be boarded up for more than six (6) months".
Section 1103.1 Where required. Insert new "The State of Illinois Accessibility Code shall control the design and construction of buildings and facilities for accessibility and use by physically disabled persons. When there is a conflict between the Illinois Accessibility Code and the accessibility requirements in the International Building Code, the stricter shall apply".
Section 1511.7 Roof covering materials: Insert new "In all occupancies, no roof materials shall be constructed over or enclosed within a new roof or new structure".
Section 1807 Rubble stone foundation walls. Delete and replace with "New rubble stone foundation walls are not permitted".
Section 1807.1.4. Permanent wood foundation systems. Delete and replace with "New wood foundation walls are not permitted".
Section 1807.1.6.2 Concrete foundation walls. Insert new "All foundation walls shall be a minimum of six (6) inches higher than the adjacent finished grade level".
Chapter 29. Delete in its entirety and insert "See the Illinois State Plumbing Code". (Ord. 19-09-16, 9-17-2019)
