4-8-5: ENFORCEMENT:
   A.   Any person violating any provision of this chapter shall be fined not less than one hundred dollars ($100.00) or more than seven hundred fifty dollars ($750.00) for each offense. Each day's continued violation shall be deemed a separate offense.
   B.   The village president is hereby authorized to designate a health officer to enforce the provisions of this chapter and to investigate the condition of the bees and colonies and, if necessary, to collect samples of bees to determine if the bees are diseased or exhibit unusually aggressive characteristics. The health officer at all reasonable times may enter in and upon any premises to enforce the provisions of this chapter. All expenses of the health officer will be charged to the owner of the property on which the colonies are located, and a copy of the inspection report will be retained by the village. If any colony is not brought into compliance with this chapter within the fifteen (15) days after the date of the notice of violation is given by the health officer, the village may remove or cause the removal of such colony at the property owner's expense.
   C.   The village may pursue any and all available legal remedies to ensure that any colony which fails to comply with this chapter or which constitutes a danger to persons or property is brought into compliance or removed. (Ord. 13-06-10, 6-4-2013)
