4-1-2: GENERAL PROVISIONS:
   A.   If approved by the president and board of trustees, the village may specify in any contract with a waste and recycling contractor that such contractor shall have the exclusive right to collect residential waste and recyclable materials from single- family dwellings.
   B.   It shall be the duty of every owner, agent, tenant or occupant of any single-family dwelling to have accumulations of residential waste collected before such accumulations become a public nuisance. The occupancy of any premises for residential purposes shall be prima facie evidence that residential waste is being produced and accumulated on such premises.
   C.   Owners, agents, tenants or occupants of single-family dwellings shall be obligated to pay the fees due any waste and recycling contractor for the services provided, in accordance with the village fee schedule, and shall only secure collection service for residential waste and recyclable materials from such waste and recycling contractor.
   D.   It shall be the duty of every owner, agent, tenant, or occupant of any single-family dwelling to place all "residential waste" and "recyclable materials" in approved containers as set forth and defined in this chapter and to maintain same in good order and in accordance with the law.
   E.   Approved containers may be placed at street side or back door for pick up (as elected by the resident) on those days when residential waste and recyclable material are to be collected by the waste and recycling contractor. Residents are hereby notified that, to guarantee garbage pick up, residential waste and recyclable material must be placed at the designated location by seven o'clock (7:00) A.M. on the day of pick up. It shall be unlawful to place any residential waste or recyclable material out for pick up before six o'clock (6:00) P.M. the day preceding the pick up day during the months from April 1 to September 30, and before four o'clock (4:00) P.M. the day preceding the pick up day for the months from October 1 to March 31. All containers shall be removed from street side placement no later than nine o'clock (9:00) P.M. on the day collection is made or twelve (12) hours after the actual collection, whichever occurs later.
   F.   Only residents electing to receive unlimited service from the waste and recycling contractor shall have no limit as to the number of approved containers which the resident can use to dispose of residential waste. Residents electing a limited service option shall not place for collection residential waste having an aggregate capacity exceeding ninety nine (99) gallons or more than three (3) approved containers, unless the resident purchases and affixes a waste sticker on each excess container. The excess container stickers shall be purchased from the waste and recycling contractor or the village, at the rates set forth in the village fee schedule.
   G.   Residents electing to have collection of landscape waste performed by the waste and recycling contractor may pay the monthly flat rate fee for such service to the contractor or elect to pay per bag. Under the first option, residents shall be limited to ten (10) 33-gallon containers or "kraft" style bags per pick up and shall pay for excess bags at the same rate as those residents pay electing a pay per bag service. The stickers for individual bags shall be purchased from the waste and recycling contractor or the village, at the rates set forth in the village fee schedule.
   H.   It shall be unlawful for containers for residential waste or recyclable material to be stored in any location except immediately behind a building, within an enclosed garage, or at the side of the building. (Ord. 12-2-3, 2-21-2012)
