3-4-8: RESTRICTIONS ON CONDUCT OF RAFFLES:
The license issued for the conduct of raffles is subject to the following restrictions:
   A.   The aggregate retail value of all prizes issued in a single raffle shall not exceed five hundred thousand dollars ($500,000.00).
   B.   The maximum retail value of each prize awarded shall not exceed two hundred thousand dollars ($200,000.00).
   C.   The maximum price which may be charged for one raffle chance shall not exceed one thousand dollars ($1,000.00).
   D.   No chances may be sold, or tickets delivered, for any raffle more than one hundred eighty (180) days prior to the date set for the determination of the winning chance.
   E.   The entire net proceeds of any raffle must be exclusively devoted to the lawful purposes of the organization permitted to conduct that raffle.
   F.   No person except a bona fide officer, employee or member of the sponsoring organization or those otherwise authorized by the sponsoring organization may participate in the management or operation of the raffle.
   G.   No person may receive any remuneration or profit for participating in the management or operation of the raffle (but this restriction shall not preclude the compensation of employees of the sponsoring organization from receiving their customary salary or wages for managing or operating the raffle).
   H.   A licensee may rent premises on which to determine the winning chance or chances in a raffle only from: 1) an organization which is also licensed under this chapter, or 2) a nonprofit corporation or organization approved in the license, 3) a governmental body or agency, or 4) a commercial entity approved in the license, but only if no rent or other charge is made for the renting of the premises above the lowest rates that are being charged by the entity for use of the same space.
   I.   Raffle chances may be sold or issued only within the area specified in the license application and winning chances may be determined only at those locations specified in the license application.
   J.   No person under the age of eighteen (18) years may participate in the conducting of raffles or chances. A person under the age of eighteen (18) years may be within the area where winning chances are being determined only when accompanied by his parent or guardian. (Ord. 07-8-11, 8-21-2007)
