3-1-10-6: CONDITIONS FOR USE OF PUBLIC WAYS:
   A.   A person seeking an initial franchise from the village shall provide a schedule for the construction of the cable system and the provision of cable service throughout the village, which schedule shall be incorporated by references into the franchise and be enforceable against the grantee.
   B.   Prior to the commencement of the initial build out of a cable system, a grantee shall prepare and submit to the village, for the village's review and approval in its sole judgment and discretion, strand maps clearly depicting the exact location of each and every pedestal to be used in the franchise area. Such grantee shall construct and complete the cable system in strict accordance with the maps as approved by the village. In such case or whenever major upgrades are proposed to the cable system, the proposed installation and facilities shall use the smallest suitable vaults, boxes, equipment enclosures, power pedestals, and/or cabinets then in use by the facility owner, regardless of location, for the particular application.
   C.   In making use of the public ways, including without limitation, performing any tree trimming in conjunction therewith, the grantee shall comply with all pertinent provisions of the ROW ordinance.
   D.   No provision in this section 3-1-10 or any franchise agreement shall: 1) abrogate the right of the village to perform any public works or public improvements of any description, 2) be construed as a waiver of any codes or ordinances of general applicability promulgated by the village, or 3) be construed as a waiver or release of the rights of the village in and to the public ways.
   E.   At the request of a private property owner, the grantee shall relocate its facilities and be entitled to reimbursement of its relocation expenses by such private owner.
   F.   A grantee shall, on the request of any person holding a building moving permit issued by the village, temporarily raise or lower its wires to permit the moving of buildings. The expenses of such temporary raising or lowering of the wires shall be paid by the person requesting the same, and the grantee may require such payment in advance. The grantee shall be given at least forty eight (48) hours' advance notice to arrange for such temporary wire changes. (Ord. 09-4-5, 4-7-2009)
