ESTABLISHMENT
§ 33.015 ESTABLISHMENT.
   There is hereby established an executive department of the village which shall be known as the Police Department, which shall consist of the Chief of Police and such other officers and police officers as the Village Board shall from time to time, by resolution, prescribe.

POLICE CHIEF
§ 33.030 APPLICATION; QUALIFICATIONS.
   There is hereby created the Office of Chief of Police who shall be the head of the Police Department. He or she shall be hired by the President with the advice and consent of the Village Board. No person shall be eligible to hold the office of Chief of Police unless he or she has knowledge of matters of public welfare, investigation of crime and criminals, crime prevention, traffic control and regulation, laws of the state and ordinances of the village, and enforcement of law, so as reasonably to qualify them in such matters. Any applicant for Police Chief shall have at least five years of full-time service as a police officer. The salary of the Police Chief shall be established from time to time by the corporate authorities in a salary ordinance. The Chief shall serve at the discretion of the Village Board. If the Chief was promoted from any rank of full-time sworn officer of Riverton Police Department and, subsequently removed from the position within 12 months of their promotion, they shall revert to the rank previously held, without regard as to whether a vacancy exists in that rank. After 12 months, return to their previous position is at the discretion of the Village Board. If the Chief is hired from outside the Riverton Police Department, they shall serve a 12-month probationary period as prescribed in the Village Personnel Code. If the Chief is hired from outside the Riverton Police Department, there is no option for them to demote to the ranks of the police officers.

§ 33.031 DUTIES.
   It shall be the duties of the Chief of Police to:
   (A)   Have the custody, care and control of the public property of the Police Department, including all firearms and other equipment and the books and records of the Department;
   (B)   Devote such time to the municipal affairs of the village as the village shall prescribe;
   (C)   Preserve the peace, order, safety and cleanliness of the village;
   (D)   Execute and enforce all ordinances, police requirements and orders of the Village Board and of the President;
   (E)   Protect the rights of persons and property;
   (F)   Provide proper police as needed at every fire;
   (G)   Cause to be enforced all ordinances of the village unless otherwise provided;
   (H)   Take notice of all nuisances, and at all times render all necessary assistance to other village officers, in the abatement thereof;
   (I)   Supervise and manage personnel that are assigned as police officers within the police department and handle all personnel actions, including: scheduling of personnel to ensure shift coverage, scheduling training, scheduling vacations and leave time, disciplining police personnel as needed, advertising vacancies, and assisting with the hiring of new officers. The Chief should be aware of and abide by all terms and conditions outlined in Collective Bargaining Agreement.
   (J)   Maintain open line of communication with Village President and Village Board. Communicate all matters to Village President and Public Safety Committee as directed.
   (K)   Aid the Fire Department by giving alarms in case of fire, and in clearing the streets or grounds in the immediate vicinity of the fire so that members of the Fire Department shall not be hindered or obstructed in the performance of their duties;
   (L)   Study police problems and matters of public welfare and administration as related to crime and law enforcement and make recommendations thereon to the President, Police Standing Committee and Village Board; investigate, study and recommend traffic regulations, routing and changes therein with a view to improving traffic conditions and lessening congestion in the streets and public places;
   (M)   Cause to be kept books or records showing in detail the work of the Police Department. Such records shall show:
      (1)   The names of all persons arrested and the date of such arrest;
      (2)   The nature of the offense charged and whether accused was imprisoned or released on bail;
      (3)   The disposition of the case;
      (4)   The amount of fine and, if paid, to whom; and
      (5)   A list of all property placed in charge of the Department.
      (6)   The name of the officer involved in the incident.
   (N)   To cause to be detailed a sufficient number of the police force to make, from time to time and as often as may be necessary, a thorough and systematic examination of the village, and to ascertain and report to the proper authority for prosecution of all violations of this code or any ordinance of the village. For this purpose, the Chief and officers of the Police Department shall be permitted at all times to visit and enter into or upon any building, lot or grounds within the jurisdiction of the village and to make examination thereof.
   (O)   To plan and execute community policing events to promote the Riverton Police Department in a positive light with the community residents. Maintain a working rapport with businesses and citizens.

DEPUTY CHIEF OF POLICE
§ 33.035 DEPUTY CHIEF OF POLICE CREATED.
   (A)   In accordance with 65 ILCS 5/10-2.1-4, the position of Deputy Chief of Police is hereby created. The Deputy Chief of Police shall be recommended by the Chief of Police and hired by the President with the advice and consent of the Village Board. The Deputy Chief position shall be an exempt rank immediately below that of Chief. The Deputy Chief shall have at least five years of full-time services as a police officer. The Deputy Chief shall serve at the discretion of the Village Board. If the Deputy Chief was promoted from any rank of full-time sworn officer of Riverton Police Department and, subsequently removed from the position within 12 months of their promotion, they shall revert to the rank previously held, without regard as to whether a vacancy exists in that rank. After 12 months, return to their previous position is at the discretion of the Village Board.
