§ 157.003 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning. All words used in the present tense include the future tense. All words in the singular include plural and all words in the plural include the singular. The word “shall” is mandatory and not directory. The word “used” shall be deemed to include “designed, intended or arranged to be used”.
   ACCESSORY USE OR BUILDING. A use customarily incidental and subordinate to the principal use or building and located on the same lot with such principal use or building.
   AGRICULTURAL USES, BONA FIDE. The growing of crops in the open, forestry, mushroom growing, flower gardening, operation of apiaries, nurseries, orchards, roadside stands, signs and billboards relating to the sale or use of products produced thereon, and necessary structures and farm dwellings for such uses. The keeping of “livestock”, as defined in this code of ordinances, is not a BONA FIDE AGRICULTURAL USE.
   AGRICULTURE. The growing, harvesting and storing of crops, including but not limited to legume, hay, grain, fruit and truck or vegetable crops, floriculture, horticulture, mushroom growing, nurseries, orchards, and vineyards, forestry and greenhouses; buildings used for growing, harvesting and preparing agricultural products for market, buildings for storing and protecting farm machinery and equipment, and retail operations for selling produce and other agricultural products produced on the same zoning lot. AGRICULTURE does not include the keeping of livestock.
   ALLEY. Any public or private way dedicated to public travel or less than 20 feet in width.
   BUILDING. Any structure constructed or used for residential, business, industrial or other public or private purposes, or accessory thereto, and including tents, lunch wagons, dining cars, trailers, billboards, signs and similar structures whether stationary or movable.
   BUILDING LINE. A line parallel to the street on which structure faces at a distance from the street equal to the depth of the front yard.
   DWELLING. A permanent building used primarily for human habitation but not including facilities for the housing of transient residents, nor to include mobile homes.
   DWELLING, MULTIPLE-FAMILY. A permanent building or portion thereof providing separate living accommodations for three or more families.
   DWELLING, SINGLE-FAMILY. A permanent building, separate and free standing, in itself providing living accommodations for one family.
   DWELLING, TWO-FAMILY. A permanent building designed exclusively for occupancy by two families.
   FRONT YARD. The yard extending across the entire width of the lot between the principal building and the right-of-way line or street line which the building faces.
   HEIGHT OF BUILDING. The vertical distance from the established average sidewalk grade, street grade or finished grade, at the building line, whichever is the highest, to the highest point of the building.
   HOME OCCUPATION. Any use conducted entirely within a dwelling by the occupant of the dwelling and as a secondary use which is clearly incidental to the use of the dwelling for residential purposes. Such a use shall employ not more than four persons outside the family resident in dwelling.
   HORSEKEEPING. The keeping, raising, boarding and feeding of horses (including miniature horses), ponies, donkeys and mules, including the keeping of such animals as pets.
   LOT. A piece, parcel or plot of land occupied or to be occupied by one principal building and its accessory buildings and including the open spaces required under this chapter.
   MINI WAREHOUSE. A building or group of buildings in a controlled-access and fenced area that contains individual, and compartmentalized stalls or lockers of varying sizes for the storage of business and household goods which are leased or rented on an individual basis. Storage of business goods is limited to those not associated with any office, retail or other business or commercial use located on the same zoning lot.
   MOBILE HOME. A structure designed for permanent habitation and so constructed as to permit its transport on wheels, temporarily or permanently attached to its frame, from the place of its construction to the location, or subsequent locations, at which it is intended to be a permanent habitation and designed to permit the occupancy thereof as a dwelling for one or more persons. The term MOBILE HOME shall include manufactured homes constructed after 6-30-1976, in accordance with the Federal National Manufactured Housing Construction and Safety Standards Act of 1974.
   MODULAR HOME.
      (1)   A factory-built home which is:
         (a)   Subject to regulation by the State Department of Public Health; and
         (b)   Not built on a permanent chassis.
      (2)   By law, a modular home must have affixed to it a yellow seal in the shape of the State of Illinois or a similar seal of the State of Indiana. A MODULAR HOME on a permanent perimeter foundation extending below the frost depth qualifies as a single-family structure in any zone in which single-family structures are allowed. Should the State Department of Public Health approve a factory-built home with a permanent chassis, such a home is not considered a MODULAR HOME under this division (2), but rather is considered a “mobile home” under this division (2).
   NURSING HOME OR ASSISTED LIVING FACILITY. A facility licensed or permitted under the Nursing Home Care Act, the Life Care Facility Act, the Assisted Living and Shared Housing Act, the Community Living Facilities Licensing Act, or subsection (a-20) of Section 30 of the Alternative Health Care Delivery Act, or a facility designated as a supportive living facility under Section 5-5.01a of the Illinois Public Aid Code.
   NURSING HOME OR ASSISTED LIVING FACILITY, LARGE. A nursing home or assisted living facility designed to house, or operated in such a manner that it houses, 20 or more residents.
   NURSING HOME OR ASSISTED LIVING FACILITY, SMALL. A nursing home or assisted living facility designed to house, or operated in such a manner that it houses, fewer than 20 residents.
   REAR YARD. The yard extending across the entire width of the lot between the rear lot line and the nearest part of the principal building.
   SIDE YARD. The yard extending along the side lot line from the front yard to the rear yard and lying between the side lot line and the nearest part of the principal building.
   STREET. Any public or private way dedicated to public travel 20 feet or more in width. The word STREET shall include the words ROAD, HIGHWAY and THOROUGHFARE.
   STRUCTURAL CHANGE (MAJOR). Any change in the supporting members of a building or structure such as bearing walls or partitions, columns, beams or girders, or any substantial structural change in the roof or in the exterior walls, but not to include repairs such as painting, glazing, siding, roofing and patching needed for normal maintenance.
   USE. The purpose or activity for which a building, structure or land is occupied or maintained.
   YARD. An open space on the same lot with a principal building, open, unoccupied and unobstructed by buildings, except as otherwise provided in this chapter.
