4-1-12: AWNINGS AND CANOPIES IN THE B1 AND R4 DISTRICTS:
   (A)   No retractable or fixed awning or canopy, hood or similar structure shall be hereafter erected, altered or replaced upon any building in any B1 or R4 District designated by the zoning ordinance 1 without first obtaining a permit from the Village Building Department and payment of the permit fee provided for in subsection 4-1-4(A) of this chapter.
   (B)   Every application for a permit to erect, alter or replace a retractable or fixed awning or canopy, hood or similar structure shall be made to the Assistant Village Manager or his or her designee upon forms furnished by the Village and signed by the owner of the property to which the permit relates. Each application shall be accompanied by plans and specifications clearly showing the design, color, size, area, component parts and materials of the awning, canopy, hood or structure in question and its dimensions as related to its location on the particular building to which it is to be attached and its distance to and height above the ground, an adjoining public sidewalk or public right-of-way.
   (C)   Every such application together with the drawing or sketch of such awning, canopy, hood or similar structure shall be reviewed and approved by the Assistant Village Manager or his or her designee as compatible in design, style, size, color and materials both with the building to which it relates and with the character and style of the surrounding area where it is to be located.
   (D)   There shall be a minimum clearance of eight feet (8') from the surface of the ground or sidewalk to the lowest part of any retractable or fixed awning, canopy, hood or similar structure.
   (E)   Retractable and fixed awnings may project over a public sidewalk or a public right-of-way, but no part thereof shall project closer than four feet (4') from the curb line of any adjacent public street or project over any public planted areas. All awnings must have a triangular profile.
   (F)   Awnings, canopies, hoods or similar structures shall comply with all applicable requirements of the Village Building Code and shall be designed and constructed to withstand a wind pressure of thirty (30) pounds per square foot of surface area and other lateral or live loads as required by the Building Code adopted by the Village, with due allowances for shape, open construction and similar features that relieve pressures or loads. Structural members shall be protected to prevent deterioration. Said structures shall consist of metal, canvas or other flexible fabric materials and shall be rendered thoroughly waterproof and so constructed as to prevent shrinkage or cracking. No glass or plastic shall be used as a construction material. All awnings, canopies, hoods and similar structures shall be supported and securely anchored, by metal brackets or by metal framework firmly attached to the building so that no supporting posts or stanchions shall encroach upon or obstruct the ground or sidewalk within a building setback area or public right-of-way over which said structures project. Retractable awnings shall be equipped with a mechanism or device for raising and holding the awning in a retracted or closed position against the face of the building to which it is attached.
   (G)   Except as otherwise provided in subsection 4-3-9(Q) of this title, no awning, canopy, hood or similar structure shall be used as a sign or for advertising; nor shall said structures be illuminated.
   (H)   No awning, canopy, hood or similar structure which is blown down, destroyed, taken down or removed, shall be re- erected, rebuilt or replaced unless in full compliance with this section. (Ord. 2967, 9-21-2017; amd. Ord. 3084, 4-15-2021)
