(A) It shall be unlawful for any person or owner of property to permit or suffer a cesspool upon their property to be uncovered or the contents thereof to overflow.

(B) It shall be unlawful to construct or maintain any privy, privy vault, cesspool or septic tank intended for or subject to receiving human excrement where a public sanitary or combined sewer is located in any street or alley adjacent to or within 100 feet of the lot or parcel of land. Where a sanitary or combined sewer is located in any street or alley adjacent to or within 100 feet of any lot or parcel of land on which is located any privy, privy vault, cesspool or septic tank intended for or subject to receiving human excrement the privy vault shall be removed and the privy vault, cesspool or septic tank shall be filled with earth.
