1610.045 AMENDMENTS.
   The following sections of the 2018 International Fire Code, as adopted in Section 1610.01 , are hereby amended as follows:
   Chapter 1 Scope and Administration.
   Section 101.1 Title. These regulations shall be known as the Fire Code of the Village of Richton Park and hereinafter referred to as this Code or Fire Code.
   Section 104.11.2 Obstructing operations. Line 8, add [Section 104.11.2.1 Vehicles Crossing Fire Hose. No person shall drive or otherwise propel a vehicle over any unprotected fire hose of the Fire Department, when such hose is laid down on any street, alleyway, private drive, or any other vehicular roadway, private or public property without the consent of the Fire Officer in command to the operation.]
   Section 109.1 Board of Appeals. Line 12, add [Section 109.1.1 Appeals. Whenever the Fire Chief disapproves an application or refuses to grant a permit applied for, or when it is claimed that the provisions of the 2018 International Fire Code adopted in Section 1610 do not apply or that the true intent and meaning of the Code have been misconstrued or wrongly interpreted, the applicant may appeal from the decision of the Fire Chief to the Board of Trustees within thirty days from the date of the decision appealed. The decision of the Board upon such appeal shall be final.]
   Section 110.1 Unlawful acts. Line 6, add [Section 110.1.1 General Code Penalty.
   (a)   Unless otherwise provided, whoever violates or fails to comply with any of the provisions of this Part Sixteen - Fire Prevention Code, including the provisions of the 2018 International Fire Code adopted in Section 1610 , and including any order of the Fire Chief or his or her authorized representative made pursuant thereto, or builds in violation of any detailed statement of specifications or plans submitted and approved thereunder, or any certificate or permit issued thereunder, and from which no appeal has been taken, or fails to comply with such an order as affirmed or modified by the Board of Trustees, within the time fixed in such Code, shall be punished as provided in Section 202.99 of these Codified Ordinances. The imposition of one penalty for any violation shall not excuse the violation or permit it to continue, and all such persons shall be required to correct or remedy such violations or defects within a reasonable time. When not otherwise specified, a separate offense shall be deemed committed for each ten days that prohibited conditions are maintained or permitted to exist.
   (b)   The application of the above penalty provided in subsection (a) hereof shall not be held to prevent the enforced removal of prohibited conditions.]
   Section 110.4 Violation penalties. Line 7, add [violating the village's adopted codes], Line 8, add [$750.00], Line 8/9, add [as defined by the Illinois State Statutes].
   Section 110.4 Violation penalties. Add a new section [Section 110.4.2 Separate offenses. It is the responsibility of the offender to abate the violation as expeditiously as possible, and each day during which such violation continues shall constitute a separate offense, punishable as provided in Section 1612.99.]
   Section 112.4 Failure to comply. Line 5, add [$100.00], Line 5 add [$750.00].
   Chapter 2 Definitions.
   Section 202 General Definitions. The subsequent definitions shall be added or revised as follows:
 
Fire Department
Richton Park Fire Department.
Fire Inspector
As appointed by the Fire Chief, to conduct inspections and administer and enforce the Codes.
Fire Officer.
The highest ranking officer (Officer-in-Charge) of the Fire Department on duty.
Fire Prevention Bureau.
The division of the Fire Department which implements inspections, investigations, and Code compliance.
 
   Chapter 5 Fire Service Features.
   Section 503 Specifications. (Fire apparatus access roads).
   Section 503.2.1 Dimensions. Line 6, add [Where the vertical distance between the grade plane and the highest roof surface exceeds 30 feet, approved aerial fire apparatus access roads shall be provided. Aerial fire apparatus access roads shall have a minimum unobstructed width of 26 feet, exclusive of shoulders, in the immediate vicinity of the building or portion thereof, and shall be capable of accommodating fire department aerial apparatus size and gross vehicle weight of 75,000 lbs. Overhead utility and power lines shall not be located within the aerial apparatus access roadway. Aerial apparatus roadway shall be located not less than 15 feet and a maximum of 30 feet from the building, and shall be positioned parallel to one entire side of the building. The side of the building on which the aerial fire apparatus access road is positioned shall be approved by the fire code official.]
   Section 503.3 Marking. Line 2, delete [or other approved notices or], add [and painted curbs, Red in color with]. Line 5, at end of sentence add [Where a curb is not provided, a 3" strip shall be painted on the pavement not less than 2" from the edge of the pavement. Painting of the curb and/or pavement shall constitute the same function as the posted signs when posted signs are unable to be installed, missing and/or damaged. Fire lane signage shall be placed no further than 100' apart. Additional signage may be needed where sight obstructions exist. Signs shall be a minimum of 7' from the curb/sidewalk to the bottom of the sign. Where lanes are 18' wide or less, signs shall be placed on both sides of the lane. Where required by the fire code official, fire apparatus access roads shall be marked with permanent NO PARKING-FIRE LANE signs complying with IFC, Appendix-D103.6 and FIGURE D103.6 FIRE LANE SIGNS.]
   Section 506 Key Boxes.
   Section 506.1 Where required.
   Amend paragraph: [When a property is protected by an automatic alarm system, and where access to or within a structure or an area is restricted because of secured openings or where immediate access is necessary for life for life-saving or fire-fighting purposes, the Fire Code Official is authorized to require a key box to be installed in an approved location with the top portion not more than 6 feet in height, measured vertically from finished grade level. The key box shall contain keys to locked points of ingress, mechanical equipment rooms, electrical rooms, elevator control rooms, fire alarm control panel rooms, and other areas as directed by the Fire Chief. Owners shall install and maintain key boxes at their own expense. The responsible party for the property, building, business shall immediately notify the fire code official and provide any new keys or access devices where locks are changed or rekeyed. All keys and access devices shall be secured inside the key box by a Richton Park Fire Department Officer or Official.
   Exception: requirements for this section shall not apply to residential buildings having fewer than five residential units, or premises maintaining twenty-four hours, seven-days-a-week, on-premises security, guard, or medical services.]
   Section 507 Fire Protection Water Supplies.
   Section 507.5.1 Where required. Line 3, delete [400], add [300]. Delete [Exceptions: 1. & 2.]
   Section 507.5.4 Obstruction. Add new: 507.5.4.1 Obstruction abatement. No person shall obscure from view, damage, deface, obstruct or restrict access to, any fire hydrant or fire department connection (FDC) for the purpose of fire suppression activities, or pressurization of fire suppression systems, including fire hydrants and FDC's located on public or private streets, access lanes or on private property.
   Section 507.5.4.1.2 Exigent abatement. Upon expiration of the time provided by the Fire Officer to remove obstructions or encroachments, the Fire Officer in command of the operation shall proceed to remove the same. The costs incurred in the performance of necessary work shall be paid from the Village treasury on the certificate of the Fire Officer, with the approval of the Village Manager; the Village Attorney shall institute appropriate action for the recovery of such costs.
   Section 507.5 Fire hydrant systems. Add at end of Section 507.5, [Section 507.5.7 Use of hydrants for other than fire suppression purposes. No person shall use or operate a fire hydrant intended for Fire Department suppression purposes unless such person first secures a permit for such use from the Fire Chief or an authorized Fire Official and the Water Department having jurisdiction. This section does not apply to persons employed by, and authorized to make such use by the Water Department having jurisdiction.]
   Section 507.5 Fire hydrant systems. Add after new Section 507.5.7, [Section 507.5.8 Authority regarding placement of hydrants and mains. The Fire Chief or his or her authorized representative shall recommend to the Village Manager the location or relocation of new or existing fire hydrants and the placement or replacement of inadequate water mains located upon public property and deemed necessary to provide an adequate fire flow and distribution pattern.]
   Section 507.5 Fire hydrant systems. Add after new Section 507.5.8, [Section 507.5.9 Hydrants for large use. All new and existing ship yards, oil storage plants, lumber yards, amusement or exhibition parks, educational or institutional complexes and similar occupancies and uses involving high fire or life hazards, which are located more than 150 feet from a public street or which require quantities of water beyond the capabilities of the public water distribution system, shall be provided with properly placed fire hydrants. Such fire hydrants shall be capable of supplying fire flows as required by the Fire Chief or his or her authorized representative and shall be connected to a water system in accordance with accepted engineering practices. The Chief or his or her representative shall designate and approve the number and location of fire hydrants, may require the installation of sufficient hose and equipment housed in accordance with the approved rules and may require the establishment of a trained fire brigade when the hazard involved requires such measures. Private hydrants shall not be placed into, or removed from, service until approved by the Chief or his or her representative.]
   Chapter 6 Building Services and Systems.
   Add new: Section 606.1.1 Automatic elevators for fire department use. At least one elevator installed in all new buildings shall be sized for stretcher use by the fire department. Minimum size to be 2500 pounds with a clear dimension of 6'8" wide x 4'3" deep with a 42" sliding door. This elevator must meet the State of Illinois requirements.
   Add new: Section 606.1.2 Elevator Emergency Call-Button Protection. All new and existing elevators shall require a device to protect the “Emergency Button” (the button that automatically contacts emergency services), located on the interior elevator panel, from accidental activation. The device shall be acceptable by the Illinois Accessibility Code (IAC) and shall not require tight grasping, tight pinching, or twisting of the wrist to operate the Emergency Button. All devices shall be approved by the fire code official. Failure to install and maintain such devices shall subject the owner to fines not less than $250.00 nor more than $750.00 for each offense.
   Exceptions: One- and two-family dwellings.
   Chapter 9 Fire Protection and Life Safety Systems.
   Section 901.1 Scope.
   Add new: Section 901.1.1 Required certifications. Fire protection systems shall be engineered, designed, and installed per applicable National Fire Protection Association (NFPA) standards and the requirements of the State of Illinois. In addition, Fire Alarm System Designers shall have a minimum of a NICET LEVEL IV certification. Fire Alarm Contractors and Installers shall have a minimum of a NICET LEVEL II certification for Fire Alarm Systems. Automatic Sprinkler System Contractors and Installers shall have a minimum NICET LEVEL IV certification for automatic fire sprinkler systems.
   Section 901.5 Installation acceptance testing.
   Add new sentence to end of paragraph: Any person conducting installation, testing, repairs, and maintenance shall be qualified and certified by a nationally accepted, accredited association acceptable to the Authority Having Jurisdiction and shall comply with Section 901.1.1.
   Section 901.7 Systems out of service.
   Add new sentence to end of paragraph: The fire code official or fire officer shall determine the number of personnel needed for a required fire watch.
   Section 901.8 Removal of or tampering with equipment.
   Add new sentence to end of paragraph: Whenever a fire appliance is removed as permitted in this section, it shall be replaced or reinstalled as soon as the purpose for which it was removed has been accomplished. Defective and non-approved fire appliances or equipment shall be replaced or repaired as directed by the Chief or his or her representative.
   Section 903 Automatic Sprinkler Systems.
   Section 903.2 Where Automatic Sprinkler Systems required.
   Amend: Approved automatic sprinkler systems in new buildings and structures, in existing commercial buildings and structures incorporating additions, expansions, substantial restoration as determined by the fire code official, or renovations where fifty percent or more of the ceiling area is open to roof decking shall be provided and in the locations described in Sections 903.2.1 through 903.2.12. Automatic sprinkler systems shall be provided throughout all new and existing buildings where any of the following exists:
   a.   Where the building is used as an educational, health care, ambulatory health care or residential board and care occupancy.
   b.   In all buildings over five thousand (5000) square feet of gross floor area of all floors combined.
   c.   In all buildings over three (3) stories in height irrespective of gross floor area.
   Exception: One-and-two family dwellings.
   Section 906.2 General requirements.
   Add new sentence to end of paragraph: No person shall sell, trade, loan or give away any form, type or kind of fire extinguisher which is not approved by the Fire Chief or his or her authorized representative, which is not in proper working order, or whose contents do not meet the requirements of the Chief or his or her representative. This section does not apply to the sale, trade or exchange of obsolete or damaged equipment for junk, provided that such equipment is permanently disfigured or marked with a permanent sign identifying the equipment as junk.
   Section 906.3 Size and Distribution.
   The minimum size fire extinguisher for use in all new and existing occupancy groups shall be 4A60BC.
   Section 907.2 Where required – new buildings and structures.
   Add new sentence to end of paragraph: A strobe device shall be installed on the exterior of each premises for new and existing buildings and structures where required by the authority having jurisdiction.
   Section 907.6.2 Power Supply.
   Add new sentence to end of paragraph: Primary power supply shall be a dedicated branch circuit to which only fire protection devices are connected. All power circuit wiring shall “listed” and installed in red-colored conduit. The fire alarm system circuit breaker shall be identified in red as “FIRE ALARM CIRCUIT” and shall have a red circuit breaker lock. All dedicated branch circuits and connections shall be protected against physical damage and shall be attached directly to the structure or building.
   Section 912 Fire Department Connections.
   Section 912.1 Installation.
   Add new sentence to end of paragraph: The size, location and type of fire department connections (FDC's) shall be approved by the fire code official. The fire department connection shall consist of one five inch Storz coupling with a 30-degree elbow mounted between 18 inches and 42 inches above the finished floor.
   Section 912.2 Location. Amended to read as follows: With respect to hydrants, driveways, buildings and landscaping, fire department connections shall be so located that fire apparatus and hose connected to supply the system will not obstruct access to the buildings for other fire apparatus. Fire department connections shall be located within 100 feet of a fire hydrant at a location approved by the code official.
   Section 915 Carbon Monoxide Alarms.
   Section 915.4 Carbon Monoxide Alarms. Add the following language to the exceptions: “Carbon monoxide alarms shall also comply with the, Carbon Monoxide Alarm Detector Act, 430 ILCS 135, for required carbon monoxide alarm installation and building owner and tenant responsibilities regarding testing, inspection and maintenance of smoke alarms. State laws are enforced through the Illinois Attorney General's Office.”
   Chapter 11 Construction Requirements for Existing Buildings.
   Section 1103.5.1 Group A-2, Line 3, delete [300], add [250 or more, or the fire area is 5000 square feet or more,]
   Section 1103.5.3 Group 1-2, Condition 2, Add new sentence to end of paragraph: An automatic sprinkler system shall be installed prior to receiving a certificate of occupancy.
   Section 1103.7 Fire Alarm Systems.
   Section 1103.7.1 Group E. Delete exceptions 1 and 2.
   Section 1103.7.2 Group 1-1. Delete exception.
   Section 3104 Temporary and Permanent Tents, Canopies and Membrane Structures.
   Section 3104.1.2 Portable Fire Extinguishers. Portable fire extinguishers shall be 4A60BC extinguisher and shall follow the provision in section 906.
   Section 3104.1.3 Occupant Load Sign. A sign with maximum occupant load must be prominently posted at the main entrance at all times.
