Any cesspool, septic tank, sewage tank or privy which is constructed or maintained on any property in violation of Section 1046.01 is hereby declared to be a public nuisance and shall be abated upon five days notice to the owner of the premises served by such private sewage disposal system. Should the owner fail or refuse to abate such nuisance within five days after receiving such notice, the Village shall abate such nuisance and the owner of the premises shall be liable to the Village for the costs and expenses of abating the same.
