An under-age establishment licensed under this chapter shall operate subject to the following restrictions:
(a) Upon application to the President and Board of Trustees, an establishment may receive a temporary license to remain open for business on up to three occasions (by way of example, for New Year's Eve, special holidays, special events), in any license year. No such establishment shall be open for business between the hours of 11:30 p.m. and 10:00 a.m.
(b) At all times during which such establishment is open for business, the establishment shall have on premises and in its employ at least three off-duty, police officers who are sworn in and actively serving as members of any municipal police department, or private security guards from a private security contractor licensed under the Private Detective, Private Alarm, Private Security and Locksmith Act of 1993.
(c) Any window coverings within the structure shall be capable of being opened to permit plain view of the interior of the establishment from adjacent public rights-of-way. At all times during which such establishment is open for business, any screen, blind, curtain, partition, or other window covering shall be open to permit plain view into the interior of the establishment from adjacent public rights-of-way.
(d) All out-of-doors areas which patrons are permitted to occupy shall be open to plain view from any adjacent public or private rights of way.
(e) Children under the age of sixteen shall not be admitted under any circumstances. No one over the age of twenty-one shall be admitted, except that parents and guardians of patrons shall be admitted.
(f) No alcohol shall be permitted on the premises.
(g) No illegal contraband, including but not limited to illicit drugs, shall be permitted on the premises.
(h) No gambling or wagering shall be permitted on the premises.
(i) No person who is visibly impaired or under the influence of alcohol or a controlled substance shall be permitted to enter or remain on the premises.
(j) Patrons shall not be permitted to enter any area which may be closed off or concealed by a door, except lavatories.
(k) No license shall be issued for any such establishment if the same is to be located within 500 feet of any liquor establishment. Such distance shall be measured from the primary customer entrance of the premises for which application has been made for a license hereunder to the nearest point of the liquor establishment building.
(l) Any establishment licensed under this chapter shall require prospective patrons to provide proof of age by displaying a valid photo ID.
(m) The licensee, or his agents or employees, shall at all times maintain order on the licensed premises, including the parking lot and areas immediately surrounding the premises under control of the licensee and shall take reasonable steps to prevent unlawful loitering on or about the premises.
(n) The licensee shall immediately notify the Police Department whenever a "breach of the peace" (as defined in Section 806.31(a)(1) of the Codified Ordinances) occurs on the licensed premises including the parking lot and areas immediately surrounding the premises under control of licensee.
