814.04 APPLICATIONS; OTHER PREREQUISITES FOR GRANT OF FRANCHISE.
   (a)   Upon consideration of the grantee's proposal to provide cable television services, after holding a public hearing on the application wherein the grantee's character and legal, financial, technical and other qualifications, and the adequacy and feasibility of the grantee's construction arrangements are duly considered, and after reimbursement to the Village of all costs incurred in connection with the drafting and award of the cable television franchise and ordinance pursuant to Section 202.15(a), the Village may grant one or more nonexclusive franchise agreements creating a conditional right to construct, install, maintain and operate a cable television system and facilities incident thereto on, over, under, across and through the public ways in the Village. However, no provision of this chapter shall be deemed or construed to require the Board of Trustees to grant a franchise. The Village reserves the right to grant a similar use of such public ways to any person at any time.
   (b)   The application for a cable television franchise shall be submitted to the Board, or its designee, in writing, and shall be in accordance with procedures and schedules to be established by the Board. The request for proposals may request facts and information the Board deems appropriate, and such application shall be accompanied by a nonrefundable filing fee of two hundred fifty dollars ($250.00).
