(a) Absence. When extenuating circumstances, for example but not limited to, poor health, mental incapacity, or absence from City for an extended period of time, cause the Mayor to be unable to perform the Mayor's duties, the President of Council shall act as the Mayor with the same powers and duties as the Mayor and shall continue as a Council member with all of the powers and duties of a Council member, except that the Council President who is acting as the Mayor shall not be able to vote in Council meetings, unless there is a tie vote, consistent with Article V, Section 4 of this Charter. (b) Vacancy. In case of death, disqualification, removal from office, or resignation of the Mayor, or in the event that a Mayor-Elect fails to qualify or take office on the date set for the commencement of the term by reason of non-election, death, resignation, or for any other cause whatsoever, there shall be deemed a vacancy in the office of Mayor. In case of a Mayor-Elect failing to qualify or take office for the reasons set forth above, the vacancy shall be deemed to exist as of the date set for the commencement of the term for which such officer was elected.
In the event of a vacancy created by a Mayor-Elect or by the Mayor before the first day of April following the last regular municipal election at which such Mayor was elected, such vacancy in the office of Mayor shall be filled by a special election to be held not more than sixty (60) days after such vacancy occurs. If such vacancy in the office of Mayor occurs on or after the first day of April following the last regular Municipal election, the President of Council shall succeed to the office of Mayor and be Mayor and serve as Mayor for the unexpired term of Mayor until the Mayor’s successor is elected and qualified. The ensuing vacancy in the office of the President of Council shall then be filled in the same manner provided in Article IV, Section 11 of this Charter. (Amended 11-6-73; 11-4-14; 11-6-18)
