(a) The Dog Warden or Police Division may impound any dog found not conforming to the standards of Sections 505.01, 505.03, 505.08 or 505.13. The Dog Warden or Police Division shall deliver the dog forthwith to an officer charged by law with the custody and disposal of such dog. If such dog is wearing a valid dog license tag or the identity of the owner or custodian is otherwise established, the Dog Warden or Police Division shall immediately give notice by phone or mail to the licensee, owner or custodian that the dog has been impounded. No dog shall be released except upon payment subject to subsection (c) hereof.
(b) The period of impounding shall be seventy-two hours. Should the owner or person in charge or control of the impounded dog not be determined within the seventy-two hour period, or should the owner or person in charge or control of the impounded dog or dogs, after being notified of the impounding, fail to claim such dog within forty-eight hours of such notification, the Dog Warden or Police Division shall dispose of the impounded dog or dogs.
(c) Any dog impounded may be reclaimed upon payment of twenty-five dollars ($25.00) by the owner or person in charge or control to the Dog Warden, plus a charge of four dollars ($4.00) for each day that the dog has been impounded.
(d) For the purpose of discharging the duties imposed by this chapter and to enforce its provisions, the Dog Warden, or any police officer is empowered to enter upon any premises upon which a dog is kept or harbored and to demand the exhibition of such dog or the license for such dog by the owner or person in charge or control of such dog. The Dog Warden may enter the premises where any dog is kept in a reportedly cruel or inhumane manner and demand to examine such dog and to take possession of such dog when, in his opinion, it requires humane treatment.
(e) Whoever interferes with, hinders or molests the Dog Warden in the performance of his duties or seeks to release any dog in the custody of the Warden except as provided in this chapter is guilty of a misdemeanor of the second degree.
(f) The Dog Warden shall keep or cause to be kept accurate and detailed records of the registration, impoundment and disposition of all dogs coming into his custody, and of the dog bite cases reported to him and the investigation thereof.
