505.08 NUISANCE CONDITIONS PROHIBITED.
   (a)   No person, being the owner or in charge or control of any dog shall continue to keep or harbor any dog which creates a nuisance as defined herein unless such dog is confined or otherwise kept under such strict control as to abate the nuisance.
   Any dog which by barking, biting, howling or which in any way injures or disturbs the quiet of any person, or which destroys or damages any lawn, tree, shrub, plant, building or other property, other than the property of the owner or person in charge or control of such dog, by scratching, digging, running, defacing, urinating or otherwise, is hereby declared to be a nuisance.
   (b)    Whoever violates this section is guilty of a minor misdemeanor for a first offense, a misdemeanor of the fourth degree for a second offense and a misdemeanor of the third degree for each subsequent offense.
   (c)   Should the animal become a repeat offender (four or more violations), the court shall order said animal to be permanently removed from the municipality and/or order the animal forfeit should the animal owner fail to comply with the order of the court.
   (d)   Should the animal owner fail to comply with the order of court to permanently remove said animal from the municipality, the owner shall be guilty of contempt and additionally shall be fined an amount of five hundred dollars ($500.00).
