953.05 CITY EXEMPT FROM CHARGES.
   The City shall be exempt from charges for water supplied or services rendered by the Municipally owned water system.

953.06 DISCONTINUANCE OF SERVICE.
   (a)   Turn-on, turn-off: In the event the account of any consumer remains unpaid for a period of thirty-five days from the billing date, the service of such consumer shall be discontinued by turning the tap valve off at the street curb box by an authorized representative of the Water/Waste Water Department. A notice of the impending action shall be mailed to the consumer five days prior to the thirty-five day cut-off period. The water shall not be turned on again until all charges and penalties have been paid. If such charges and penalties are paid prior to 1:00 p. m., service shall be turned on the day of payment. If paid after 1:00 p.m., service shall be turned on the next working day.

   (b)   If any user permits any waste of water or illegal diversion of water by unauthorized turn-on of water, fraud, or other violation of City ordinance or of the rules and regulations of the Director of Public Service, the service to such consumer shall be discontinued by turning the tap valve off at the street curb box by an authorized representative of the Water/Waste Water Department and a fee of two hundred dollars ($200.00) plus a water loss calculation of 25,000 gallons at the current water rate schedule shall be assessed for this turn-off/turn-on action. The water shall not be turned on again until all charges, fees and penalties have been paid.

953.07 AGENTS MAY COLLECT WATER CHARGES.
   The Director of Public Service is hereby authorized to designate certain merchants in the City to collect the charges provided for in Sections 953.01 and 953.04.

953.08 CONTRACTS FOR COLLECTION.
   The Director of Public Service is hereby authorized to enter into contracts for the collection of charges by agents as provided in Section 953.07. The contracts shall provide for compensation to the designated agent by the payer of the charge and shall further providE that the agent shall provide bond to the City in the amount of one thousand dollars ($1,000) for faithful performance of the contract.

953.09 SPECIAL CHARGES.
   The following charges shall be assessed for the specific special services furnished by the Water/Wastewater Department:
   (a)   No charge shall be made for each trip to turn off or turn on a service, if such action is requested by the account holder for service issues; i.e. service line repair, leaks, or other water issues during the hours of 8:00 a.m. to 4:00 p.m. If an after hour call out is required, the charge is fifty dollars ($50.00) for each two hour call out.
   (b)   A charge of twenty dollars ($20.00) shall be made to service a meter damaged by negligence, plus the cost of repair or a new meter if required.

   (c)   A charge of fifty dollars ($50.00) shall be made to turn off and on a service that has been discontinued for nonpayment of a deposit. If the deposit and penalty are paid prior to 3:00 p.m. service shall be turned on the day of payment. If paid after 3:00 p.m., service shall be turned on the next working day.
   (d)   A charge of ten dollars ($10.00) shall be charged for each additional trip required when arrangements are made to have a water meter hung and it cannot be hung due to the house being locked, plumbing not ready, the remote wire not run or remote reader not hung.

   (e)   A charge of fifty dollars ($50.00) shall be made to turn on a service that has been discontinued at the water street curb box valve for non payment in accordance with City Code Section 953.06.

953.10 UNPAID CHARGES A LIEN.
   (a)   Each charge levied by or pursuant to this chapter is hereby made a lien upon the corresponding lot, parcel of land, building or premises served by a connection to the water main or line, and if the same is not paid, it shall be certified to the County Auditor who shall place the same on the tax duplicate of the County with the interest and penalties allowed by law, to be collected as other taxes are collected.

   (b)   It shall be a buyer and seller responsibility, where property is sold, to assure that a final reading of water consumption is made and provisions agreed to for payment; otherwise, the responsibility for payment for any water usage whatsoever shall be the responsibility of the current owners of such property.
