§ 4.08 "PRE-CODE" MANUFACTURED (MOBILE) HOMES.
   Subd. 1.   Definitions. The following terms, as used in this section, shall have the meanings stated.
      A.   The term "HUD Code" means built after 6-14-1976, to present in accordance with HUD 24 C.F.R. § 3280 Construction Standards. Units must bear a construction label on exterior of home as required HUD 24 C.F.R. § 3280.11.
         1.   A permanent label shall be affixed to each transportable section of each manufactured home for sale or lease in the United States. This label shall be separate and distinct from the data plate which the manufacturer is required to provide under 24 C.F.R. § 3280.5 of the standards.
         2.   The label shall be approximately two inches by four inches in size and shall be permanently attached to the manufactured home by means of four blind rivets, drive screws or other means that render it difficult to remove without defacing it. It shall be etched on 0.32-inch thick aluminum plate. The label number shall be etched or stamped with a three-letter designation which identifies the production inspection primary inspection agency and which the Secretary shall assign. Each label shall be marked with a six-digit number which the label supplier shall furnish. The labels shall be stamped with numbers sequentially.
         3.   The label shall read as follows: As evidenced by this label No. ABC000001, the manufacturer certifies to the best of the manufacturer's knowledge and belief that this manufactured home has been inspected in accordance with the requirements of the Department of Housing and Urban Development and is constructed in conformance with the federal manufactured home construction and safety standards in effect on the date of manufacture. See data plate.
         4.   The label shall be located at the tail-light end of each transportable section of the manufactured home approximately one foot up from the floor and one foot in from the road side or as near that location on a permanent part of the exterior of the manufactured home unit as practicable. The road side is the right side of the manufactured home when one views the manufactured home from the tow bar end of the manufactured home.
      B.   The term "pre-code" means built prior to 7-1-1972. Units were not required to be built or inspected to any recognized code. State Building Codes to not apply to these units.
      C.   The term "state code" means built 7-1-1972 to 6-14-1976. Minnesota Construction Label or Wisconsin, Indiana, Nebraska or other states verification of construction compliance to ANSI A199.1. Units must bear a construction label on exterior of home as verification of construction and inspection for compliance to ANSI A119.1 Standards during original construction.
   Subd. 2.   "Pre-Code" Manufactured (Mobile) Homes Defined. Manufactured (mobile) homes built prior to HUD 24 C.F.R. § 3280 Standards, effective 6-15-1976, or built prior to individual states' inspection and certification in accordance with ANSI Standards A119.1, 7-1-1972.
   Subd. 3.   Certificate of Occupancy Required. It is unlawful to occupy a "pre-code" manufactured home, after the effective date of this section, without first obtaining a certificate of occupancy from the Building Official.
   Subd. 4.   Issuance of a Certificate of Occupancy. Prior to issuance of a certificate of occupancy, "pre-code" manufactured homes shall be inspected by the Building Official for compliance with the following provisions:
      A.   Exits and Egress Windows.
         1. Each home shall have at least one egress window in each bedroom, that meets the minimum specifications of HUD 24 C.F.R. §§ 3280.106 and 3280.404 for manufactured homes. These standards require that the window be at least 22 inches in the horizontal or vertical least dimension and at least five square feet in area, the bottom of the window opening shall be not more than 36 inches above the floor, and that locks and latches which need to be operated to permit exiting not be located more than 54 inches above the finished floor. May also meet requirements of 1995 State Building Code and/or ANSI A119.1, 1972.
         2. Each home shall have two exterior exit doors located remote from each other as required in HUD 24 C.F.R. § 3280.105. These standards require single section manufactured homes to have the doors not less than 12-foot center to center from each other and multi-section manufactured home doors not less than 20-foot center to center from each other measured in straight line direction regardless of length of path of travel between doors. One of the required exit doors shall be accessible from the doorway of each bedroom without traveling more than 35 feet. Exterior swing door shall have a minimum 28-inch by 74-inch clear opening and sliding glass doors shall have a 28-inch by 72-inch clear opening. Each exterior door other than screen/storm doors shall have a key-operated lock that has a deadlocking latch or a key-operated dead bolt with a passage latch and locks shall not require the use of a key or special tool for operation from the inside of the home.
      B.   Flame Spread.
         1.   Walls and ceilings adjacent to or enclosing a furnace or water heater shall have an interior finish with flame spread rating not exceeding 25. Sealants and other trim materials two inches or less used to finish adjacent surfaces within these spaces are exempt from this provision provided all joints are supported by framing members or materials having a flame spread rating not exceeding 25. Combustible doors which provide interior or exterior access to furnace and/or water heater spaces shall be covered with materials of limited combustion (i.e. five-sixteenths inch gypsum board and the like) with the surface allowed to be interrupted for louvers ventilating the enclosure. However, the louvers shall not be of materials of greater combustibility than the door itself (i.e., plastic louvers on a wooden door). Reference HUD 24 C.F.R. § 3280.203.
         2.   Exposed interior finishes adjacent to the cooking range shall have a flame spread rating not exceeding 50 (backsplashes not exceeding six inches in height are exempted), as required by 24 C.F.R. § 3280.203. Vertical clearance above cook tops and ranges shall be not less than 24 inches as required by HUD 24 C.F.R. § 3280.709.
      C.   Smoke Detectors.
         1.   At least one smoke detector must be installed in each of the following locations:
            a.   To protect both the living area and kitchen space: the detector shall be located in the living area remote from the kitchen and cooling appliances. A smoke detector located within 20 feet horizontally of a cooking appliance must incorporate a temporary silencing feature or be of a photoelectric type.
            b.   In each room designed for sleeping.
            c.   On the ceiling of the upper level near the top or above each stairway, other than a basement stairway, in any multistory home. The detector must be located so that smoke rising in the stairway cannot be prevented from reaching the detector by an intervening door or obstruction.
            d.   For each home placed over a basement, a detector in the basement.
            e.   A smoke detector required under this section must not be placed in a location that impairs its effectiveness or in any of the following locations:
               (1)   Within three feet horizontally from any discharge grille when a home is equipped or designed for future installation of a roof-mounted evaporative cooler or other equipment discharging conditioned air through a ceiling grille into the living space; and
               (2)   In any location or environment that is prohibited by the terms of its listing, except as permitted by this section.
         2.   Each smoke detector must be powered from the electrical system of the homes as a primary power source and a battery as a secondary power source or battery rated for a ten-year life, provided the smoke detector is listed for use with a ten-year battery. Each smoke detector whose primary power source is the home electrical system must be mounted on an electrical outlet box and connected by a permanent wiring method to a general electrical circuit. More than one smoke detector is permitted to be placed on the same electrical circuit. The wiring circuit for the detector must not only include any switches between the over-current protective device and the detector, and must not be protected by a ground fault circuit interrupter.
         3.   Smoke detectors shall not have switches in the circuit to the detector between the over-current protector device protecting the branch circuit and the detector. The detector shall be attached to an electrical outlet box and connected by a permanent wiring method into a general electrical circuit. The detector shall not be placed on a branch circuit or any circuit protected by a ground fault circuit interrupter.
      D.   Solid Fuel Burning Stove and Fireplace.
         1.   Solid fuel burning factory-built fireplaces and fireplace stoves may be used in manufactured (mobile) homes provided that they are listed for use in manufactured homes and installed as per their listing/manufacturer's instructions and minimum requirements of HUD 24 C.F.R. § 3280.710.
         2.   A solid fuel burning fireplace or fireplace stove shall be equipped with integral doors designed to close the fire chamber opening and shall include complete means for venting through the roof, a combustion air inlet, hearth extension and means to securely attach the unit to the manufactured home structure.
         3.   A listed factory-built chimney designed to be attached directly to the fireplace/fireplace stove and equipped with, in accordance with the listing, a termination device and spark arrester shall be required. The chimney shall extend at least three feet above the part of the roof through which it passes and at least two feet above the highest elevation of any part of the manufactured home within ten feet of the chimney.
         4.   An air intake assembly shall be installed in accordance with the terms of listings/manufacturers' instructions. A combustion air inlet shall conduct the air directly into the fire chamber and shall be designed to prevent material from the hearth dropping onto the area beneath the manufactured home.
         5.   The hearth extension shall be of noncombustible material minimum three-eighths inch thick, shall extend a minimum 16 inches in from and eight inches beyond each side of the fireplace/fireplace stove opening. The hearth shall also extend over the entire surface beneath a fireplace stove and beneath an elevated or overhanging fireplace.
      E.   Support System. Pre-Code homes built prior to 6-15-1976, are required to be installed (set-up) to any generic installation standard that has been adopted and accepted by the authority having jurisdiction (i.e., NCSBCS ANSI A225) or individual standards developed by states; MSBC Chapter 1350.
      F.   Aluminum Electrical Wiring. All electrical systems shall be tested for continuity to assure that metallic parts are properly bonded, tested for operation to demonstrate that all equipment is connected and in working order and a polarity check to determine that connections are proper. The electrical system shall be properly protected for the required amperage load. If the unit is of aluminum conductors, all receptacles and switches rated 20 amperes or less directly connected to the aluminum conductor shall be marked CO/ALR. Exterior receptacles other than heat tape receptacles shall be of the ground fault circuit interrupter (GFI) type. Conductors of dissimilar metals (copper/ aluminum/or copper clad aluminum shall be connected in accordance with NEC § 110.14.
      G.   Replacement Furnaces and Water Heaters.
         1.   If the manufacturer (mobile) home has had or is to receive a replacement furnace or water heater, it shall be listed for use in a manufactured (mobile) home. Vents, roof jacks and chimneys necessary for the installation shall be listed for use with the furnace or water heater.
         2.   The furnace and water heater shall be secured in place to avoid displacement. Every furnace and water heater shall be accessible for servicing and/or replacement.
         3.   Furnaces and water heaters shall be installed to provide complete separation of the combustion system from the interior atmosphere of the manufactured home as required by HUD 24 C.F.R. § 3280.709:
            a.   Installation of direct vent system (seal combustion system) furnace and water heater; and
            b.   Installation of furnace and water heater within enclosures which separate the furnace and water heater venting system from the atmosphere of the home. There shall be no doors, grills, removable access panels or other openings into the enclosure from the inside of the manufactured home. All openings for ducts, piping, wiring and the like shall be sealed.
         4.   The floor area in the water heater area shall be free from damage from moisture and the like to assure that the floor will support the weight of the water heater and water contained within.
      H.   Gas Lines/Testing. The unit's gas piping shall be tested with the appliance valves removed from the piping and capped at those areas. The piping shall withstand a pressure of at least six inches mercury or three psi gauge for a period of not less than ten minutes without showing any drop in pressure. Pressure shall be measured with a mercury manometer or a slope gauge calibrated so as to read in increments of not greater than one-tenth pound or equivalent device. The source of normal operating pressure shall be isolated before the pressure test is made. After the appliance connections are reinstalled, the piping system and connections shall be tested with line pressure of not less than ten inches nor more than 14 inches water column air pressure. The appliance connections shall be tested for leakage with soapy water or bubble solution.
   Subd. 5.   Compliance Inspection Fees. Pursuant to Minn. Rules 1302.0600, Subpart 1B (Minnesota State Building Code), the city shall require an inspection fee for each mobile home unit to be placed in a mobile home park.
