§ 1497.99 PENALTY.
   In addition to or as an alternative to any penalty provided herein or by law, any person who violates or fails to comply with the provisions of this chapter shall be deemed guilty of a misdemeanor of the fourth degree. Each day during which any violation of any of the provisions of this chapter is committed, continued, or permitted, shall constitute a separate offense. For a subsequent offense, such person is guilty of a misdemeanor of the first degree and shall be subject to the appropriate fine or imprisonment or both. A separate offense shall be deemed committed each day during which a violation or noncompliance occurs or continues.
