(A) A skilled swimmer shall be present at all times that a private residential swimming pool is in use. A lifeguard shall be present at all times that a public swimming pool is in use.
(B) Every swimming pool shall be equipped with one or more throwing ring buoys not more than 15 inches in diameter and having 60 feet of three-sixteenths of an inch Manila line attached, and one or more light but strong poles with blunted ends and not less than 12 feet in length for making reach assists or rescues.
(C) No diving board or platform more than three feet above water level shall be installed for use in connection with a private residential swimming pool.
(D) Lifesaving equipment approved by the Board of Health shall be provided and maintained so as to be immediately available for use in an emergency.
(E) In the case of an indoor public swimming pool (an indoor pool being defined as a pool completely enclosed by a building), a lifeguard shall not be required if:
(1) At least two signs with a minimum of two-inch lettering are posted in conspicuous places around the pool stating that the pool is unguarded;
(2) No children are allowed in or around the pool area unless accompanied by an adult;
(3) Only one point of entry to the pool area is provided (Note: Emergency doors as provided for by the fire prevention code adopted in Part Sixteen of these codified ordinances must be provided); and
(4) A telephone is provided in or near the pool area for use in case of an emergency, with the location of such telephone posted in a conspicuous place.
