For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
BLOCK, SUBDIVISION, NEIGHBORHOOD, COMMUNITY OR OTHER SPECIFIED AREA. An area on which two or more separate residence buildings are located.
DISPLAY POOL. Any type of pool defined under the definitions of “private residential swimming pool” or “public swimming pool” in this section and used for advertising, display or any other purpose in connection with the operation of a business or industry. All provisions of this chapter that are applicable to public swimming pools are applicable also to display pools, and the words SWIMMING POOL, where used in this chapter, include DISPLAY POOL.
HEALTH COMMISSIONER. The legally designated Health Commissioner of the City Health District or his or her authorized representatives.
MULTIFAMILY DWELLING. A unit containing four or more separate family dwellings.
PERSON. Includes an individual, firm, corporation, association or partnership.
PRIVATE RESIDENTIAL SWIMMING POOL. A receptacle for water, or an artificial pool of water having a depth at any point of more than two feet, intended for the purpose of immersion or partial immersion therein of human beings, and including all appurtenant equipment constructed, installed and maintained in or above the ground outside of a building used for a single-family, two-family or three-family dwelling unit. However, such private residential swimming pool shall be maintained by an individual primarily for the sole use of his or her household and guests and not for the purpose of profit or in connection with any business operated for profit. No outdoor swimming pool intended for the use of members, and their guests, of a nonprofit club or organization, or limited to house residents of a multifamily dwelling, a block, subdivision, neighborhood, community or other specified area of residence, shall be permitted with a single-family residence, duplex residence or three-family residence.
PUBLIC SWIMMING POOL. A bathing place of artificial or partly artificial and partly natural construction located either indoors or outdoors and provided with a controlled water supply, where the water is sufficiently deep for complete immersion of the body and is used collectively by numbers of persons for swimming or recreative bathing, together with the surrounding area, buildings, equipment and appurtenances pertaining to such bathing place. PUBLIC SWIMMING POOL does not include a bathing place accessory to a single-family, two-family or three-family dwelling which is intended only for use of the residents and friends.
