§ 1062.01 CONTROL OF CITY PARKS.
   (A)   Festivals; permit required. No person shall conduct a festival or other activity in the city parks that is designed to attract the general public and/or where entertainment, prize, food or other concession booths will be established or where beer will be offered for sale, without first obtaining a permit therefor from the city. There shall be no charge for the permit, but a refundable deposit may be required to ensure the cleaning of the park, after the festival or other activity, acceptable to the Safety-Service Director. If such cleaning is not acceptable, charges may be assessed by the Director for labor to clean the park. No such permit shall be issued unless and until the organization or individual requesting the permit agrees to and complies with the following provisions.
   (B)   Special events.
      (1)   A detailed plan for the event must be submitted to the Police Department for safety and security review and such plan must include:
         (a)   The dates and times the park will be in use;
         (b)   The names, addresses and phone numbers of all persons in control of the event;
         (c)   The names and addresses of all persons providing amusement rides, including a statement that they are certified by the state and that such rides have been properly inspected and are in a safe condition for public use;
         (d)   A copy of any permit issued by the state or the federal government that allows the organization to sell beer; and
         (e)   A map or general drawing that shows the location and a description of the various types of booths that will be employed on the premises.
      (2)   Such organization shall provide a suitably secure depository for all moneys accumulated during the operation of the event. This depository must be manned at all times, be able to be locked and not open to the general public.
      (3)   Such organization shall agree to employ a number of off duty, sworn, police officers for the safety and security of the event, the protection of city property and the protection of the general public.
      (4)   Any organization that will include in the event a fireworks display or that will explode any device announcing the event shall:
         (a)   Show proof that the person hired for such a display is insured; and
         (b)   Provide the Fire Department with adequate information as to the types of fireworks and displays to be used and allow for the inspection and proper installation of a below ground “mortar” for the discharge of “aerial bombs.”
   (C)   General park rules. The following general rules and regulations for the use of the city parks shall prevail:
      (1)   Park hours are 7:00 a.m. to 11:00 p.m.
      (2)   All concession booths operating during festivals and special events shall cease operation at 11:00 p.m. and the parks shall be emptied by midnight.
      (3)   No glass container is permitted in a park at any time.
      (4)   No intoxicating liquor or malt beverage may be brought into a park at any time.
      (5)   No motorized vehicle shall be allowed in the parks, with the following exceptions:
         (a)   Commercial vehicles loading or unloading supplies or equipment;
         (b)   Motorized carts or wheelchairs used by handicapped persons;
         (c)   Municipally owned vehicles;
         (d)   Privately owned vehicles used in connection with special events and then only while in the process of loading or unloading materials or supplies for the event; and
         (e)   House or trailer-type vehicles containing a concession booth or used as a depository for moneys collected during the event.
      (6)   No inning of any baseball game or period of any other sporting event shall be allowed to start after 10:45 p.m.
      (7)   On those days when the park has been let to a permit holder for a special event and the event is in progress, no person shall bring into the park any alcoholic beverage.
      (8)   No alcoholic beverage of any kind shall be permitted in Veterans Memorial Stadium.
      (9)   All dogs brought into the park shall be on leash and under the control of a handler.
      (10)    The Safety-Service Director shall have the power to establish any and all other reasonable restrictions for park use, with the approval of Council.
      (11)    Use of the north baseball field at Hilltop Park by persons more than 12 years of age is strictly prohibited.
