§ 1060.02 MUNICIPAL GARBAGE COLLECTION FOR MULTI-FAMILY RESIDENTIAL UNITS ELIMINATED.
   (A)   The City Council finds it necessary and in the best interest of the citizens of the city to eliminate municipal garbage collection for multi-family, residential units.
   (B)   For purposes of this section, the term MULTI-FAMILY, RESIDENTIAL UNITS includes all buildings and structures used for residential purposes which contain two or more separate dwelling units that are made available for lease or rent for a term of months or years. It does not include condominiums or any building or structure in which one-half or more of the dwelling units are owner occupied.
   (C)   The owner of a two-family residential structure within the city that is not owner occupied may participate in the city's garbage collection and billing program on the same basis as similar structures that are owner occupied. Such participation shall begin with the first quarterly billing following receipt of written notice directed to the Safety-Service Director that such participation is desired.
