§ 1026.07 REMOVAL OF DEPOSITS OF EARTH MATERIAL.
   No person shall fail to remove any earth material which has been deposited or dropped upon a public street, right of way, easement or other public property in connection with the makIng of any excavation or the digging, grading or removal of any earth material. To avoid a violation of this section, such removal shall be accomplished within the normal construction working hours of the same day such earth material was so deposited or dropped, or such removal shall be accomplished immediately if, in the opinion of the Safety-Service Director or his or her authorized agent, such earth material constitutes a traffic hazard. This section applies only to the owner of the property upon which such work is being performed, to the person acting as the general contractor having supervision over such work and to any person actually performing such work.
