For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
FOOD SERVICE OPERATION. Means:
(1) Any place, including any governmental operation, where meals or lunches, or portions thereof, are prepared or served for a consideration, regardless of whether the meals, lunches or portions are to be consumed on or off the premises, except:
(a) Homes containing what is commonly known as the family unit and their nonpaying guests;
(b) Operations serving a meal or lunch to five or fewer persons;
(c) Churches, schools, fraternal or veterans organizations serving meals or lunches or portions thereof, on their premises, provided that the meals, lunches or portions are served on no more than seven consecutive days, or not more than 52 separate days, in any calendar year;
(d) Dining and sleeping cars;
(e) Food-processing and food-manufacturing establishments; and
(f) Type A and Type B family day-care homes, as defined in Ohio R.C. 5104.01.
(2) Any shop, commissary or similar place of operation from which automatic food or beverage vending machines are serviced, or any location at which food or beverage vending machines have been installed, provided that this chapter shall not apply to:
(a) Vending machines dispensing only bottled, canned or prepackaged nonperishable beverages, or the places of operation from which they are serviced;
(b) Vending machines dispensing only prepackaged, nonperishable confections, crackers or cookies, or the places from which they are serviced;
(c) Vending machines dispensing only chewing gum, salted nuts, nuts in their natural protective covering or panned bulk candies, provided that all such machines which are not in use in Ohio on January 1, 1963, shall be of a type and design approved by the Ohio Department of Health; and
(d) Commissaries servicing vending machines dispensing only milk, milk products or frozen desserts which are under an inspection and analysis program acceptable to the Department of Health.
(3) Mobile food service operations; and
(4) Temporary food service operations.
LICENSOR. The Reading Board of Health, as authorized by Ohio R.C. 3709.05.
MOBILE FOOD SERVICE OPERATION. Any unit where meals or lunches, or portions thereof, are prepared or served for consideration for a single event, in one location, for a period of not longer than five consecutive days, regardless of whether the meals, lunches or portions are to be consumed on or off the premises.
MOBILE FOOD SERVICE OPERATION COMMISSARY. Any shop or similar place of operation where food, beverages, ingredients or other supplies for mobile food service operations are stored by a mobile food service operator.
TEMPORARY FOOD SERVICE OPERATION. Any place, including any governmental operations, where meals or lunches, or portions thereof, are prepared or served for a consideration for a single event, in one location, for a period of not longer than five consecutive days, regardless of whether the meals, lunches or portions are to be consumed on or off the premises.
VENDING MACHINE. Any self-service device offered for use which, upon insertion of a coin, coins or token, or by other means, dispenses unit serving of food, either in bulk or in packages, without the necessity of replenishing the device between each vending operation, except such vending machines which dispense only bottled, canned or prepackaged, nonperishable beverages or prepackaged, nonperishable confections, crackers or cookies.
VENDING MACHINE COMMISSARY. Any shop, commissary or similar place of operation where food, beverages, ingredients, containers or supplies for vending machines are stored by a vending machine operator, except commissaries servicing vending machines dispensing only milk, milk products or frozen desserts which are under an inspection and analysis program acceptable to the Department of Health.
VENDING MACHINE LOCATION. Any place where one or more vending machines, owned by the same person, firm or corporation, are installed. Each story, room or similar division to a building or area constitutes a separate location, and no two vending machines are more than 150 feet apart.
